One of the most depressing aspects of all the talk about Israel or the United States destroying Iran’s nuclear facilities (and much else besides, no doubt) is the near absence of any reference to international law. Even so distinguished an expert as Anthony Cordesman seems to take it for granted that there will be no legal impediment to the US attacking Iran if a credible threat of an attack fails to intimidate Iran into making the concessions required to pacify Israel.
In my country, Britain, on February 20, 2012, members of the House of Commons spent five hours debating whether the use of force against Iran would be “productive” without dwelling more than cursorily on the legal aspects of the question.
How is one to account for this blind spot? Are ignorance and oversight to blame, or has respect for international law gone out of fashion?
It’s hard to believe that anyone who has policy-making responsibilities that involve other states, or who takes a professional interest in such policy-making, can be unaware of what the bed-rock of the post-1945 international system has to say about war-making…
…So much of the contemporary foreign policy debate seems to take place in a moral vacuum, with little or no reference to justice and the rule of law in international affairs. I am almost embarrassed to be using such words.
Yet it seems to me rational to suggest that the post-1945 international system is the best yet devised, that it has brought great benefits to the West, that its preservation requires commitment from the leading power of the age, and that the leading power has to marry justice to strength to retain the loyalty of other participants. If I’m right, treating Iran unlawfully is a bad option.
Let’s look at the Melos analogy, which many Historians credit as the first tangible example of Realpolitik in action. Wikipedia provides a great little synopsis of the Melian Dialogue…
The dialogue is between unnamed Athenian envoys sent by generals Cleomedes son of Lycomedes and Tisias son of Tisimachus to negotiate with unnamed Melians

Iran complains to UN about Israel’s threats
Iran’s Deputy Ambassador to the UN has written to the UN Secretary General to condemn the threats against Iran made by Israeli officials, stressing that such statements are “a threat to humanity.”
And then delivered the coup de grâce to the specious claims of Israel and the AIPAC funded US ‘think tanks’…
NAM participants can visit Iran’s nuclear facilities
Iranian Foreign Ministry said on Saturday that Iran will allow officials from the Non-Aligned Movement to visit nuclear facilities during a summit in Tehran which opens on Sunday and runs until Friday, MNA reported.
The move is intended to show that Iran’s nuclear activities are peaceful.
Iran will also schedule trips to industrial and scientific sites, the ministry said.
The visits will be arranged according to the interests of “our guests,” the ministry spokesman Ramin Mehmanparast told reporters…

White House: Diplomacy ‘Still Viable’ With Iran
The Obama Administration is always quick to issue a condemnation of Iran after any new IAEA report is made public. Today they broke a record, however, by issuing that condemnation before the report has even been released.
The reaction comments are seen as an attempt to preempt Israeli attempts to spin the upcoming report as an excuse for war, because while they include the usual condemnations they also insist there is “time and space” for diplomacy to continue.
Anonymous administration officials even took a page out of war opponents’ books, noting that Iran’s production of 20 percent uranium, far below weapons-grade, could not be changed to weapons-grade up without the IAEA’s notice since they continue to be a presence at the facility…

…The Obama administration insisted Friday that “there is time and space” for a diplomatic solution to the Iranian nuclear crisis, despite new evidence, to be released next week by international nuclear inspectors, that Iran is bolstering its ability to produce a type of uranium that can be converted relatively quickly to bomb fuel.
In a statement that was notable chiefly for the fact that it was issued before the International Atomic Energy Agency’s report is scheduled to be made public, a White House spokesman, Tommy Vietor, said Iran “is continuing to violate its international obligations” despite the imposition of sanctions that severely restrict the country’s oil revenue.
Exactly what violations are the Iranians violating under their NPT obligations, Mr. Vietor…?

Nuke agency forms special Iran team
Diplomats tell The Associated Press that the U.N. nuclear agency is forming a special Iran team, drawing together sleuths in weapons technology, intelligence analysis, radiation and other fields of expertise.
They say the goal is to add muscle to a probe of suspicions that Tehran worked secretly on atomic arms.
Creating a unit focused on only one country is an unusual move for the International Atomic Energy Agency, reflecting the priority it attaches to Iran amid fears it is moving closer to the ability to make nuclear weapons.
Iran denies it is interested in possessing nuclear weapons and says it has never worked on developing them.
The four diplomats demanded anonymity because they were not authorized to divulge the confidential IAEA plans.

Smoke and mirrors. A nuclear Iran would check mate Israel’s and the US ambitions in the area as well as with the occupied territories.
Most especially Israeli plans for a pipeline and port for their oil in the med which just happens to be in Gaza.
The IAEA under Mohamed El Baradei was at least somewhat independent of the US and its zionist front men in Israel. This is no longer of the IAEA under Yukiya Amano – quite the reverse, the IAEA and its director general actively shill the American-Israeli lies and warmongering.

The current reading of Iran’s strategy is that it is technologically positioning itself (as Japan has done BTW) within the terms of the NPT to be able to quickly develop, manufacture, and deploy nuclear weapons in the event of an NPT breakout. Israel’s behavior is key to this concern but not the only one.
Israel, for it’s part, seeks nuclear monopoly in the Middle East (or at least within MRBM range) so that it can have a free hand in the theft of Palestine.
The US seeks to undo a regime of nuclear weapons threats because as diplomatic tools they are pretty much worthless unless you have a monopoly. And as actual military weapons, they have proven worthless, needlessly destructive except in a scorched earth strategy, and morally contentious. Every President since Eisenhower has sought some way of eliminating nuclear weapons from the world’s aresenals. Since Reagan, the policy has been for the US and Russia (earlier the Soviet Union) to negotiate and implement large reductions in nuclear weapons to a point at which other nuclear nations would have the security to negotiate a complete elimination of nuclear weapons. And to ensure that no new nations develop and build nuclear weapons. And until the Bush administration, except for India and Pakistan, that policy worked. Both Brazil and South Africa decided to end their nuclear programs. President Carter succeeded in getting Latin American nations to agree that Latin America was a nuclear-free zone. There is a Pacific nuclear-free zone.
Bush undid that with his Axis of Evil speech. It allowed the North Korean breakout and encouraged neo-con suspicions of Iran that backfired with the election of Ahmedinejad.
It is very clear that the neo-cons, especially those who seek a position in a Romney administration want to use the pre-election season to stamped the US into a war with Iran and that there has been collusion with Netanyahu on this. And they want to use Obama’s policy of continued negotiations as an argument of “Democratic weakness on national security”.
In the face of this, it seems that Iran has been very careful in pursuing a policy of trying to take away the “enemy” that Saudi Arabia, Israel, and the US have constructed. The tours offered the non-aligned nations are a tactic in that approach and can produce UN scrutiny of the politicizing of what should be IAEA technical reports that isolates the US. (Israel is already isolated and has been for three decades.)
The international law system is rooted in the United Nations and especially in the UN Security Council. The very structure of that body says that if you are one of the five permanent members with a veto-US, UK, France, Russia, China, international law does not apply to you. That is why there is so much interest in rejiggering who those permanent members are.

Not in fact correct. Both countries agreed to mothball their programmes not to end them. Although it would be more difficult for the South Africans to do so both the Brazilians and the Argentinians could re-start their programmes relatively quickly and easily. This is particularly the case with the Brazilian military programme which underpinned their civilian one.

For the record I was in Iran when Ahmadinejad was elected and was travelling through Iran for much of the election campaign. He won as a reformist and as a reformist moreover of the generation that fought in the Iran – Irak war. His platform was entirely domestic and dealt with such matters as food-prices, ensuring greater access to medical services, and increased university construction and access in the provinces. He also promised to prosecute corruption vigorously. To try to pretend even by implication that Americans had even the tiniest influence on that election is a load of

Israel – thanks for the fix. Although in all three cases there was substantial US diplomatic efforts expended to prevent the breakout.
On the election of Ahmedinejad – then the fact that the US went from talks about normalizing relations to the Bush reversal calling them a part of the Axis of Evil had no impact on the election at all. Well then, no effect no foul. It was a great Bush policy relative to reducing nuclear weapons. Just like the Iraq War (see, no nuclear weapons). My emphasis was on the failure of US NPT policy through stupidity in this case and not especially about the issues in the Iranian election.

Failure of American NPT policy was a given, I’d say it was a consumation devoutly to be wished by neocons and that the North Korean “failure” was an acceptable cost as far as they were concerned. When the Bush administration shifted from multi to unilateralism it immediately put the kybosh on something that was inherently multilateral. Feature not bug.
All politics is domestic (or local or however you want to put it). This is quite as true of Iranian elections as it is of politics everywhere else and even more so in an election marking a generational shift.

For the Bush administration, yes it was a feature. The Obama administration has made noises of reversing that stance on NPT and has certainly acted more multilaterally–even letting other nations appear to drive actions or honoring their concerns.
The best case resolution of the US negotiations with Iran would be an acceptance of a situation like Brazil and Japan. And the beginnings of normalization of relations after 33 years. And paper it over by Iran appearing to have given ground. It is Israel, not the US, that would not like that solution and Republican posturing on Iran (to reinforce “Carter’s humiliation”) that stands in the way of normalization of relations with Iran, just as it does with normalization of relations with Cuba.
