Late last week, Senator Chuck Grassley (R-IA) released a draft internal immigration policy memo (pdf) that one or more anonymous anti-immigrant Department of Homeland Security employees had leaked to his office. Shortly before the leak of the draft memo from USCIS, the federal immigration agency which is part of DHS, Senator Grassley, along with seven other Republican Senators, had sent a letter to President Obama warning him against taking the kinds of actions outlined in the draft memo that would ameliorate some of the current unreasonably harsh immigration policies that separate families and punish children.
The policy changes would have:
* Given DHS greater latitude to defer the deportation of undocumented youth brought here as children by their parents.
* Protected spouses and children of members of the military from being deported.
* Eased interpretation of the current strict standard for showing that deportation of a parent, child, or spouse has caused "extreme hardship" to the remaining U.S. citizen family member. Currently, forced long-term (10 years or more) separation from one’s spouse or child cannot be used as a factor in deciding whether "extreme hardship" exists.
* Finalized the rules dealing with children who come to the U.S. alone, and for victims of human trafficking, domestic violence, and other criminal activities.
* Permitted USCIS to exercise discretion to target criminals for deportation proceedings in line with ICE’s stated enforcement priorities.
To me and others, these seem like common sense measures that should have been adopted long ago. To the anti-immigrant groups behind this manufactured scandal, the draft policy memo is the greatest outrage the world has ever known.
Senator Grassley is working closely with the nativist group NumbersUSA, a member of eugenicist John Tanton’s network of anti-immigrant organizations, in an effort to use the leak of this draft policy memo to destroy any chance of immigration reform that remains this legislative session. The leak came just as Senator Lindsey Graham (R-SC) proposed a constitutional amendment to revoke birthright citizenship, which could lead to the deportation of citizen children of undocumented parents.
The leak of the draft memo, which was written in April, followed a letter in June from the same group of GOP Senators warning President Obama not to enact administrative reforms in lieu of comprehensive immigration reform. The release of the June letter shows that Grassley and NumbersUSA had the draft memo then and were holding on to it until its release would have maximum political impact.
The timing of the release, coming in the same week that Senate Majority Leader Harry Reid (D-NV) and Speaker of the House Nancy Pelosi (D-CA) met to discuss moving the DREAM Act forward separate from comprehensive immigration reform [note: Reid's office is now denying that he discussed the DREAM Act with Pelosi at their meeting last week], the same week that communities around the country mobilized in opposition to SB1070, was no coincidence in my view. The leak was timed to derail the momentum the DREAM Act had gotten over months and years of organizing efforts by DREAMers, including a civil disobedience action in D.C. on July 20 where 21 undocumented youth risked deportation by being arrested in the Senate office buildings and an ongoing hunger strike now in its 12th day in California. The leak was designed to increase pressure on Obama to maintain existing federal SB1070-style programs like 287g that promote collaboration between local law enforcement and ICE and lead to racial profiling of brown-skinned people.
If this is the best attack the nativists can muster, if this is their "secret weapon" against the DREAM Act or any other legislative action on immigration, then I think the pro-migrant community is in good shape.
I believe that the Obama administration, based on its speedy public retreat from the draft memo after a short PR blitz by the nativist caucus in the Senate and NumbersUSA late last week, is not now likely to enact the reforms outlined in the draft memo despite the favorable response from the Latin@ community the leak prompted. On the subject of immigration, Obama has shown very little backbone. The administration still doesn’t seem to believe it needs the Latin@ vote. The administration doesn’t appear to believe that Latin@s will stay home in significant numbers this fall or in 2012 given the complete failure of Democrats to move any immigration reform whatsoever despite holding the White House and both houses of Congress with wide majorities. The administration appears to believe that as long as the GOP is working hand in glove with anti-immigrant groups like NumbersUSA, Latin@s will always vote for Democrats no matter how little progress Democrats ever make on immigration reform and how little they appear to care about this issue of importance to the Latin@ community.
Beyond political cowardice, the leak of the draft memo and the administration’s lackluster response also publicly exposes the institutional bias against immigrants that I see from DHS every single day as an immigration attorney. Maybe those at the top like Janet Napolitano, or even the local USCIS District Directors, don’t see it, but my clients and I certainly do. We see it in the antagonistic green card interviews, the bad faith efforts by adjudicating officers to sabotage legitimate cases, the burdensome and unreasonable requests for evidence, and the constant shifting of unwritten policies and guidelines that makes it so difficult for immigrants to navigate the legal immigration system successfully.
All of this makes it even more important to pass the DREAM Act this session. It is important for the immigrant rights community because we know now that the Obama administration cannot or will not prevent the nativists from taking control of its own agencies that regulate immigration on the federal level. The inability or unwillingness of the President to control message and policy when confronted with an anonymous anti-immigrant employee within DHS speaks volumes about this administration’s immigration policy priorities.
And passing the DREAM Act this session should be a priority for Democrats if they want to see any engagement at all in November from immigrant rights voters, who have already given up any hope of a comprehensive solution from Democrats in Congress. Democratic leadership has repeatedly broken promises to the community to even introduce a comprehensive reform bill, and so far they’ve met with no measurable consequence. That will not be the case in November when these voters stay home.
So here are my take away points from this whole pathetic affair:
* Elements of the mainstream GOP, caving to pressure from anti-immigrant forces, have adopted ridiculous policy positions like deporting Latin@ citizen children.
* Anti-immigrant groups like NumbersUSA are feeling panicked at the momentum the immigrant rights movement has gotten from the DREAM Act and pushback against SB1070, and will take any desperate measure to stop the tide from turning in this struggle.
* The leak itself and the White House’s cowardly response confirms the deep, institutional anti-immigrant bias of DHS and the shallowness of the President’s commitment to the Latin@ community.
* The success of DREAM Act organizers at least in part likely triggered this response, and the best chance to salvage any forward momentum this legislative session before large Democratic losses in November is to pass the DREAM Act as soon as possible.

A leak OMG it couldn’t be one of those king g left overs could it? This wh is the problem because they didn’t clean these people out or this is what they wanted. I’ll go with the second one.

Her injunction of SB 1070 has opened the eyes of more than half the population of the United States, which would have remained repressed by most of the Liberal press. Not building the real—PAIRED PARALLEL FENCES–transversely over the 1800 miles, separating us from Mexico. Nor is it fully completed, however President Dwight Eisenhower had the monumental courage in 1954 to remove illegal nationals from America’s soil. Today’s politicians prefer to hide the illegal alien invasion, under the proverbial rug. One of the most scandalous laws that has been badly misconstrued is the 14th amendment, which needs urgently to be repealed—this is birthright citizenship.
Forget about the facade of hard luck stories of illegal parents, being separated from their birthright citizenship child as they are ought to be deported, but this seldom happens if at all? Legal basis for birthright citizenships stems from the 14th Amendment to the U.S. Constitution. Although the original intent of the 14th Amendment was to provide former slaves citizenship after the Civil War, including the right to due process. This Amendment has progressed to have far-reaching repercussions beyond the intent of the authors. The “Anchor Baby” illuminates the whole unraveling story, which if an illegal alien parent, can reach America before the baby is born, they can collect welfare from any state. In 2006 this was a $6 billion dollar “legal flimflam” unfairly supported by US taxpayers. In other developed nations one parent must be naturalized or citizen born in that country. These families knew exactly what they were exploiting when they came to the U.S. and had a baby born on U.S. soil, as the news of welfare entitlements spreads very quickly from poor country to country.
For illegal immigrants, having a child born in the U.S. becomes this intentional “Racket” to residing here in this land, the ramifications in 2007 was estimated to be 380.000 children annually that taxpayers forfeited in taxes. Birthright citizenship creates a massive fiscal burden on the US taxpayer. At the present time “Anchor babies” are United States citizens from the moment they’re born, and they immediately qualify for public welfare aid.

FAIR estimates there are currently more than 425,000 children born to illegal aliens each year. This figure is based on the crude birth rate of the total foreign-born population (33 births per 1000) and the size of the illegal alien population (13 million in 2008). In 1994, California paid for 74,987 deliveries to illegal alien mothers, at a total cost of $215.2 million (an average of $2,842 per delivery). Illegal alien mothers accounted for 36 percent of all Medi-Cal funded births in California that year and now count substantially more than half.

I assume that several of Mr. Grassley’s staff have temporarily disappeared while being interrogated to elicit the name and identity of that leaker, who imperiled national security and the president’s legislative agenda on the topic of immigration. Tell me not, oh Washington Post, that the leaker is being ignored in principal and because s/he did no damage the administration considers important.
The news on immigration—and many other matters— is so sad, it makes me want to move to another country. If only Canada had better weather.
You can’t get into Canada. They don’t want massive, unregulated immigration either. They let in people who either have a particular NEEDED skill, and/or you have to live in a low population area, frequently remote, where that skill is needed.
They don’t want millions of ordinary folks that don’t have something specific to offer, who will just become a drag on their social services. They are a sensible country in so many, many ways. Immigration being one of them.
We should heed and emmulate their example in more ways than one.

Great post! Do you think that Lindsey Graham’s proposal for a Constitutional Amendment to amend the 14th Amendment to end birthright citizenship for those children born to persons not legally present in the U.S. is a “stalking horse” offer from the Republican Party as they price that they seek for providing a handful of votes for any favorable immigration legislation? Those eager for any scraps that Congress may throw to the pro-immigrant community always seem to be more than willing to make a deal with the devil for next to nothing; par for the course for what passes for political negotiations in the Obama Administration.
Obama has shown very little spine in most areas. So it’s not surprising that he wouldn’t show it in this area either.
There are alot of people, who are not rascists, that simply don’t want massive amounts of folks from around the world coming in and taking root. Doesn’t matter the color of their skin/hair. We have plenty of people in our country. People from the outside are not needed at this stage of our development. We need to work on taking better care of the folks we have, not on taking on more people from other countries.
The 14th Amendment had a very specific purpose. Giving citizenry to the children of uninvited people from other countries, was not it. No one is talking about revoking current citizenship status of children alive and here currently. There is almost no other country on earth that gives automatic citizenship to illegal immigrants children. So all you folks that love Canada for their gun laws, and England for their healthcare, and France for their workers rights……they also don’t give auto citizenship. Nobody is going to get left without citizenship. If you are a Mexican and give birth this side of the border, then your child should be Mexican. Easy really. In the event that there actually exists a country in this world that wouldn’t recognize the birth of one of their own citizens children, fine, we should give those children American citizenship.
I know you all think I’m horrible a rascist, wealthy, won over by FOX news (which I don’t watch), an evangelical christian GOP, Sarah Palin loving freak (which I’m none of), ruined by the media, blah, blah, blah, blah…… I actually just simply think we have enough folks in this country and don’t need to let bunches more in….from anywhere.
The solution is to pass comprehensive immigration reform. The chickenshits in D.C. need to do their job.
Until they are up to the task, my god, they need to pass the DREAM Act. Have they got no compunction, compassion, love, or understanding in their hears at all???????? You can’t allow people to come in her willy nilly and do nothing about it for 20-30 years and then decide you hate all of them!!! It’s ridiculous. Especially the children. Don’t punish them. It wasn’t their idea to be born here, or be dragged over the border illegally. They are here and they have to be educated, fed, housed, and brought up to be productive members of our society…IN FULL.
The Canadian border fence story is one of the most pathetic examples that people throw out. Most Canadians don’t want to come to America. They have their own very nice country thank you very much. They have excellent healthcare, childcare, education, freedoms, civil liberties, etc. Folks south of the border on the otherhand are starving, poor, uneducated, oppressed and desperate to get the fuck out of their own countries in search for a better life. (can’t blame them!) There is absolutely NO comparison on these two borders….NONE. To use that as an example is lame at best.
With all of that said…..an illegal is an illegal. Send em back whence they came.
Finally, put employers in prison for a minumum mandatory 10 yrs. That will stop the hiring of illegals.

Actually, it’s a very good thing for progressives and those who recognize the need for comprehensive (conservative code for “amnesty”) immigration reform that Obama has folded like a cheap lawn chair on the “leaked” memo issue.
Like a maverick steer, the issue of what to do with the millions of illegals and their off-spring needs to cut from the herd of all the other immigration reforms needed (border security, employer mandates, e-verify, etc.) and be discussed as a single, stand alone issue IN THE LIGHT OF DAY AND IN THE PUBLIC ARENA.
That is the only fair way to get good, fair and compassionate reform on this highly charged “people” issue. Trying to solve what to do with all the illegal people problem by executive fiat will only antognize the problem, not solve it…
Will one of you people who supports amnesty for illegal immigrants please post your address. See my neighborhood suffers from a pretty high crime rate, and the county I live in has an official unemployment rate of 14%. Its kind of rough here right now. If one of you would give me your address, I’ll creep in one night, and find myself some little corner to call my own. I won’t take up much space and you won’t miss the small amount of food, water and electricity I’ll use.

Thanks, robgard. Proposed repeal of the 14th Amendment comes straight from pressure from the loonies, it was not until recently at all a mainstream position. I kind of hope the GOP keeps pushing it forward because it really clarifies the civil rights issues in the immigration struggle and could engage non-Latin@ ally communities (Asian-American, African-American, progressive) on the issue in a way that they haven’t been so far. It’s not part of a grand bargain, GOP is uniformly against comprehensive immigration reform right now.
Also yes I agree, White House and Democratic leadership’s commitment to immigrant rights has been, how to put it politely, lackluster. It’s hard for Obama to be committed to immigrant rights when he is much more firmly committed to surpassing Bush’s deportation totals and building “the dang fence.”

Two years of service in military or college is only one of the requirements. The others are: GED or high school diploma, good moral character including clean criminal record, was brought to U.S. before age 16 and lived here at least 5 years before passage of the Act, and under age 35.
The main point of the bill is to provide a path to status for people brought to the U.S. as children who’ve grown up here as Americans and have no options to legalize status. It’s no handout … I know Dreamers who came here as infants and have put themselves through college against all odds. I wouldn’t want to deport that person, would you?
