On page 51 of the CIA Office of Inspector General report on torture released today, we have this paragraph:

From the unredacted portion we can see that someone, in the course of interrogating Khalid Sheikh Mohammed, said "We’re going to kill your children" if anything else happens in the US. Lest anyone think this was an idle threat, it should be noted that KSM was captured and interrogated in March, 2003. In that same month, this report appeared in The Telegraph:
Two young sons of Khalid Sheikh Mohammed, the suspected mastermind of the September 11 attacks, are being used by the CIA to force their father to talk.
Yousef al-Khalid, nine, and his brother, Abed al-Khalid, seven, were taken into custody in Pakistan last September when intelligence officers raided a flat in Karachi where their father had been hiding.
Since his children were captured about six months before he was, KSM would have known that the US had access to them.
The article continues:
Last night CIA interrogators confirmed that the boys were staying at a secret address where they were being encouraged to talk about their father’s activities.
"We are handling them with kid gloves. After all, they are only little children," said one official, "but we need to know as much about their father’s recent activities as possible. We have child psychologists on hand at all times and they are given the best of care."
Their father, Mohammed, 37, is being interrogated at the Bagram US military base in Afghanistan. He is being held in solitary confinement and subjected to "stress and duress"-style interrogation techniques.
We now know, of course, that KSM’s "stress and duress" consisted of, among other things, being waterboarded 183 times.
But we can add even more context to the thought processes of those who orchestrated the torture of suspected terrorists. In 2005, John Yoo had this to say in a debate:
Doug Cassel: If the president deems that he’s got to torture somebody, including by crushing the testicles of the person’s child, there is no law that can stop him?
John Yoo: No treaty.
Doug Cassel: Also no law by Congress — that is what you wrote in the August 2002 memo…
John Yoo: I think it depends on why the President thinks he needs to do that.
Since Yoo authored some of the legal "justifications" for the interrogation processes and likely was aware of what was done with and to KSM’s children, this statement becomes even more chilling. What is in the rest of the paragraph? Were the children hurt in any way? Was KSM forced to watch real or falsified mistreatment of them?
With so much of the relevant paragraph in the OIG report redacted, there is no way to know what else was discovered in the OIG investigation. It appears that the paragraph is based on a report from "an experienced Agency interrogator" who presumably was upset by what the other interrogators said. Note that each of the three times the other investigators are mentioned, there is a fairly long word in front of "investigators" that is redacted. The words "contractor" and "Blackwater" both seem about the right length and would fit the context of the paragraph. It appears that the large redaction in the paragraph begins with an additional statement attributed to one of the rogue interrogators. Was the interrogator telling KSM that the children were in US custody? If so, why was that redacted if that fact was already reported in the British press in 2003?
There will be no way to put this awful episode of torture behind us until we know where the children of Khalid Sheikh Mohammed are and if they have been mistreated while in US custody. As I pointed out this diary, two children of Aafia Siddiqui also are missing.
I call on Attorney General Holder to release the remainder of paragraph 95 of the OIG report and to provide a public report on the location and well being of all four children discussed here. No matter the crimes of their parents, innocent children should never be used as pawns by our government. The behavior disclosed so far is shocking and abhorrent. Unfortunately, the extensive redaction of this section and the continued silence from the government regarding these children raise the possibility that information that is significantly more shocking has been concealed.

Jim White you are always so right on to everything. And you are so right about this. It is a hole (one of thousands) in the story that should be followed up on and made a big thing of.
Do you really still believe that the U.S. and Obama and DOJ intend to pursue this ? I think they are a bunch of smarmy weasels and this should all be turned over to The World Court.
What ever we have to do to take this away from them. They are not serious at all.
The U.S. is an International Criminal Country and the people responsible need to be called to justice.
Thats what I think now , anyhow.
Thank you so much for this! I’ve used material from it to write to AG Holder this evening, cc. to President Obama.
The Durham investigation must include finding out what happened to the children.
They haunt me. Finding out, and holding accountable those responsible, goes to the core of who we are as a people.
I do wonder who those “child psychologists” were, and who was giving the sons of Khalid Sheik Mohammed — in a confined setting, apparently, and deprived of seeing their mother — “the best of care.”
Some one knows.
Here, a US employee made a threat against children held in detention by the US. The employee and the children were in the same country if not on the same base. Certainly the public should have assurances that these kids are safe and free.
What would constitute an assurance? Two of Aafia Siddiqui’s children are apparently permanently missing. All the U.S. has done about it is deny they were ever in custody, something that is trivially simple with missing children and no records. No one in this entire debate and dispute over the U.S. and torture has succeeded in placing so much as one iota of burden of proof on the government, so covering crimes is as easy as not keeping any records.
Given what we know of these interrogators, and the sinister minds of actors such as Yoo & Cheney (no doubt the VP was personally involved in the minutiae of these atrocities) I think we can safely assume the worst.
Recommended. Thanks, Jim. I scrolled through so much blackened pages that I missed those few words. Those interrogators put ants on those children’s legs to “encourage” them to tell on their father. Food and water were also withheld from them.
Expertise at deception and lying determine the outcome of many (most ?) of the CIA’s operations. This report is a pitiful attempt at plausible deniability. Next comes the scapegoat. This Big Black Bogus document dump is an insult to the American people.
At the rate we’re going, Jim, I rather doubt we’re going to find out what happened to those kids. Nothing ever gets un-redacted, and we’ve been told to look forward, not back. Repeatedly.
A decision must be made by August 27th as to whether or not Dr. Siddiqui’s case goes to the International Court of Justice.

“The Lahore High Court on Monday granted more time to the federal government to file its reply on a petition seeking repatriation of Dr Aafia Siddiqui, facing a trail in America, through International Court of Justice (ICJ).
The DAG requested the court to adjourn hearing for 15 days. The court, however, granted nine days with strict direction to file reply till August 27 at any cost.
Justice Ijaz Ahmed Chaudhry had already restrained the federal government from releasing $2 million to three American lawyers for pleading the case of Dr Aafia Siddiqui in American courts.
The court had also inquired of the federal government as to any objection if the matter is referred to the ICJ. “

“Her trial date is set for Oct 19. The statement expressed the hope that the team will work in the best interests of Aafia Siddiqui and strive to get her home in a speedy fashion despite the challenges of time imposed by the court. The statement said that the family is “humbled and grateful” for the “enormous” support of the Pakistani people along with people of conscience around the world. “We also want to thank the many sincere and courageous people in the Government of Pakistan and the Pakistani embassy in Washington, DC, whose efforts made history by exercising Pakistan’s right under Article 36 of the Vienna Convention for Consular Relations to provide a legal defense for Aafia,” it said. “Time was running out and it had become clear to all observers that the court-appointed attorneys could not mount an effective defence of (Aafia Siddiqui), in part because of the severe handicaps placed on them by the court in terms of resources, independence and limited time allotted to them,” the statement said. “In partnership with the Muslim Legal Fund of America (MLFA), we recommended and endorse the legal team retained by the Government of Pakistan to defend Aafia”. “

Thanks so much for those updates.
You’re welcome. Elaine Sharpe is one of the lawyers. She was the first one who ‘took’ Dr. Siddiqui’s case when she first arrived in the US. Here are the other two lawyers. I dare say that we might see the unexpectedly quick repatriation of Aafia back to Pakistan because these two are going to shred the bullshit stories that the US has spun. From Swift’s Aafia case page is the explanation for why at one point an article from the FBI in 2008 stated that the boy said he was an orphan and why a DNA test was done. Remember that short video of Aafia and that boy together in Ghazni where he does not speak and does not look at her? The one taken before her alleged female Rambo routine?
*************
“Aafia’s oldest son, Ahmed, who is a U.S. citizen, was found in Ghazni, Afghanistan after thinking he was an orphan and, in late 2008, was reunited with the help of the Red Cross with Aafia’s sister in Karachi, Pakistan. (Prior to that, Ahmed was reunited with Aafia for a short time in Ghazni, but he did not recognize that Aafia was his mother.) “

Blue, most of us are familiar with the CIA’s mind control programs going back probably during the WWII days of the old OSS. “Induced memory erasure”; Al Zubadah and other detainees also exhibit this symptom.
Abu Zubaydah was severely head injured 10 years before his capture and horrendous torture. He still could say what torture he endured. “KSM” had full use of his memory when at his Guantanamo hearing in 2007. In fact, he gave a long American history lesson. Assuming of course that those actually were his words. He even gave his opinion of Manifest Destiny. If you read the stories at Andy Worthington’s blog, you will maybe be surprised to learn how intact their memories are. That is exactly why the innocent are still there. They remember and can say who kidnapped and sold them, they can say what torture they endured and where they were when it happened. Except for some of the black sites; only Condi and the Europeans know where they were and still are. I don’t doubt that many of the war criminals wish that the prisoner’s memories were gone, but they are not. “

It is strange and sad and horrific… how the “intention” [sic] is to retrieve memories, but instead memories, and indelible ones, are created and will become a shameful part of our history.
They did not wait until August 27th for a decision on sending her case to the ICJ. Aafia’s new lawyers have been paid.

“Tuesday, August 25, 2009
THE federal government on Monday informed the Lahore High Court that Rs 180 million had been paid to three American lawyers for defending Dr Aafia Siddiqui in the US courts prior to the LHC’s restraining order in this regard.
Deputy Attorney General Naveed Inayat Malik informed the court that Rs 50 million had been paid to each of the three attorneys while Rs 30 million were allocated for administrative purposes. He said the amount was released to certain lawyers on the suggestion of Aafia’s brother who was residing in America. After hearing the arguments, the court directed the federal government to submit details of the payment and to reveal the names of lawyers by August 31. “

My hat (tinfoil that it may be) is off to you, Blue. Your research skills are unmatched IMHO. Thank you.
Blue, I know the literal explanation of our rising oceans, but for me it is a fitting symbol of Mother Earth weeping for her innocent, abused and murdered children ravished by heartless, soulless madmen let loose by my own country.
Thank you, Bluebutterfly.
And mine back at you! Mother Nature weeps, but she renews, also. The grand experiment..we have free will. With what some people do with that is proof that we are only 0.05% genetically different from the Neanderthals..’g’.
I want proof these kids are alive and well including testicles.
Then evaluate them for mental damage and give them the necessary long term care.
On crushing testicles the memo places no limits on this activity. By hand or vice grips or a clamp or the jaws of life, there’s a lot of ways to crush Children’s Testicles. Can we rest assured that after water boarding this fellow 183 times and not getting the desired result his children”s testicles weren’t crushed in front of him?
What’s the guarantee that crushing a child’s testicles won’t result in traumatic death from shock?
It just occurred to me that back during the election, the hard right had no problem with a “hands off the children” position when it came to Sarah Palin and her daughter’s pregnancy. Why are KSM’s children not treated the same way? Why can they be detained and possibly tortured in front of their father, no matter how evil he is? What did these children do to deserve this?
Excellent diary Jim.
Damn Jim….Thanks

Can you imagine if the Bush twins had been kidnapped/captured and were being interrogated for their fathers illegal and immoral war in Iraq…for the hundreds of thousands dead and injured for the 5 million Iraqi refugees.
Can you imagine how Americans would be outraged?
Do you think this part of the documents will make the MSM? Will Rachel, Keith or Chris Matthews or CNN address this. Or will it continue to be endless coverage about Micheal Jacksons death?
Thank you Jim.
This should a petition.
Let’s hope RACHEL, KEITH ,CHRIS MATTHEWS OR CNN picks this up. Will not be holding my breath. Too much to report about Micheal Jackson
How long have Mary, Jim, Bmaz etc been talking about these kids being abducted. I thought I had read that there were threats of rape?
FDL could should please please please put this one on the front page. This one should not disappear into the archives so soon.
Ditto.
Additionally, I think Mary has thought, for some time, that the children are possibly dead.
Insane. This post should be spread far and wide. Sending to Raw Story, Crooks and Liars, Washington Note. Hope others will do the same…spread it. Maybe the MSMers will finally pick it up
Has anyone filed habeas corpus petitions on behalf of the missing children?
If not, I hope it will be done so we can find out where the kids are, their condition and what happened to them.
They do mention KSM’s children over at Raw Story
http://rawstory.com/08/news/20…..rogations/
“The report says one interrogator threatened to kill the children of a Sept. 11 suspect, and another may have threatened to [sexually] assault a suspect’s mother in front of him,” the Associated Press reported.

10:00CIA Interrogations of Detainees
Attorney General Eric Holder has appointed a prosecutor to investigate whether CIA interrogators or contractors may have violated anti-torture laws: An update on the Obama administration counter terrorism policies.
Guests
H. Bryan Cunningham, attorney; former deputy legal adviser to the National Security Council, legal advisor to the CIA, and federal prosecutor.
R. Jeffrey Smith, reporter, Washington Post
David Cole, professor of law at Georgetown University Law Center and author of “The Torture Memos: Rationalizing the Unthinkable”. Previous books include “Less Safe, Less Free,” and “Terrorism and the Constitution.”
Dick Cheney, in a characteristically unrepentent statement released today:
“The documents released Monday clearly demonstrate that the individuals subjected to Enhanced Interrogation Techniques provided the bulk of intelligence we gained about al Qaeda. This intelligence saved lives and prevented terrorist attacks. These detainees also, according to the documents, played a role in nearly every capture of al Qaeda members and associates since 2002. The activities of the CIA in carrying out the policies of the Bush Administration were directly responsible for defeating all efforts by al Qaeda to launch further mass casualty attacks against the United States. The people involved deserve our gratitude. They do not deserve to be the targets of political investigations or prosecutions. President Obama’s decision to allow the Justice Department to investigate and possibly prosecute CIA personnel, and his decision to remove authority for interrogation from the CIA to the White House, serves as a reminder, if any were needed, of why so many Americans have doubts about this Administration’s ability to be responsible for our nation’s security.”
All those torture success stories must be contained in redacted Paragraph 95, ’cause otherweise he’s reading a different report.
Among Cheney’s dark powers, can his spectacles read through all that black ink? If he wants to convince us he should get that said ink removed so we can also learn whether he is lying.
To Jim White, thank you for your comments on Salon.com from yesterday’s Glenn Greenwald post. You have a fierce and loyal attachment to logic and facts which I highly appreciate.
Thanks. It’s been a crazy couple of days over there…
Nice piece Jim. Excellent.
Thanks.
