Since the New York Times published an article about President Obama’s assassination-by-drone program, several writers, including Glenn Greenwald (here, here, here, here, and here), Tom Engelhardt (here), and Kevin Gosztola (here, here, here, here here and here) have posted articles condemning it.
I am appalled and sickened by Obama’s definition of a “militant” as any male of military age within the strike zone, unless posthumously determined to be innocent. This is a conclusive presumption of guilt and death sentence based on apparent age, gender and presence near an intended target, or in the case of signature strikes, mere association with others who also fit the definition and profile of a militant.
There is no discernible difference between this policy and the Vietnam War policy,
Kill ‘em all and let God sort them out.
The decision to target a specific individual depends on the information available about that individual which may come from a variety of sources who are reliable and unreliable. The Attorney General and the President of the United States, who is a former Constitutional Law professor, assure us that the process by which the president decides whom to kill satisfies the Due Process Clause of the Fifth Amendment. Yet, the president does nothing more than review a Power Point production with a photo of the individual under consideration with a bullet point list of alleged roles and activities in which he has engaged.
I was a criminal defense attorney for 30 years defending people charged with felonies, including death penalty offenses, and a law professor for three years teaching Criminal Law, Criminal Procedure and Causes of Wrongful Convictions. I can assure y’all that the process by which he makes these decisions is materially indistinguishable from a Star Chamber Proceeding. That is precisely what the Due Process Clause was intended and designed to prevent.
Do not ever forget that the Due Process Clause includes the Sixth Amendment right to counsel and the right to present a defense. One cannot have due process without those rights.
Even with those rights, the presumption of innocence and a jury trial, innocent people are wrongfully convicted of crimes they did not commit. According to the Cardozo Innocence Project, 292 people innocent people have been exonerated by post-conviction DNA evidence.
The seven causes of wrongful convictions are:
1. Mistaken eyewitness testimony;
2. Police Misconduct;
3. Prosecutorial Misconduct;
4. False Confessions;
5. Forensic Fraud;
6. Ineffective Assistance of Counsel; and
7. Jailhouse Informant Testimony
Note that only a small percentage of cases have biological evidence where it is possible to conduct a DNA test that will inculpate or exculpate a defendant. The seven causes of wrongful convictions can cause a wrongful conviction in any case.
The Department of Justice surveyed all public and private DNA labs in the country in the early 90s to determine how often each lab exculpated a prime suspect with a DNA test. The average rate varied little from lab to lab, whether public or private. The average rate was 22.5%
To nevertheless murder people without any meaningful process according to ridiculously overbroad definition of a militant is at best reckless homicide and at worst premeditated murder. Given its continuing use despite a high civilian casualty rate makes it premeditated murder.
To accept and allow this contrived exception to due process to stand is to tolerate an exception that swallows the rule. No American should tolerate it and no American should vote for the man who issues the order to kill. He is a murderer, a war criminal and utterly unfit to serve as President of the United States.
Anyone who votes for him will walk out of the voting booth with innocent blood on their hands.
Innocent blood that will never wash out.
I have another reason that motivated me to write this article.
President Obama obviously authorized the story in the New York Times because there is an election coming up in November and he wanted to portray himself as the candidate with the right stuff, ready, able and willing to make courageous and necessary decisions to keep all Americans safe.
But it does not take courage to order others to kill ‘em all and let God sort them out, posthumously. And it does not take courage to look at a set of Power Point slides and, like a Roman emperor, issue a thumbs up or thumbs down sign.
Those are the acts of a murderous coward afraid of losing an election.

Yes, I believe he should be charged with war crimes, accorded due process that he never accorded to any of his many victims, convicted, and sentenced to spend the rest of his life in prison.

You know what’s even more morally repugnant than the President using PowerPoint slides to determine who lives or dies? In several of the most recent attacks there have been second attacks on those rushing to provide aide to victims of the first attacks. This is morally reprehensible. We are now the terrorists!
For the President to selectively leak info about his To Kill List and hoping for some political advantage to derive from it does indeed show us what an unprincipled man he has become. This is cold!

They also used drones to fire Hellfire missiles at the funerals of people they killed in earlier strikes.
I don’t think that Presidents actually get to decide when and where the Military strikes.
Be that as it may, the Constitution says that the President is responsible for those decisions, and therefore it is our duty as press to assume that he does in fact dictate those decisions.
Therefore, in my own news writing, I report Obama’s Military as carrying out Obama’s will, because it really is his job to speak up if they do something wrong. Now is that time to speak up.
No, Obama personally selects the people to be targeted for assassination and his orders are carried out by the military and the CIA. He also defined militants as all males of military age in a strike zone who are not posthumously determined to be innocent and groups of such people who appear to be up to no good.
The military and the CIA carry out his orders to kill all such groups of people.
This is why so many innocent people are being slaughtered.
Evidently, he’s fine with that and doesn’t give a damn.
Do you not think that he signs off on what is presented to him by his Military & intelligence advisers, having little expertise himself?

You know what I have difficulty imagining? The AF drone pilots at Creech AFB in Nevada handing over their consoles and joysticks to the next shift of pilots, going out to their cars and rushing to take their kids to soccer practice, going shopping at the mall, after having incinerated men, women, and kids 8,000 miles away. Does the remoteness of the killing allow them to make it easier for them to assuage their consciences? Drone warfare means we are losing more of what makes us human: our ability to empathize with our fellow humans.

Point well taken, but I understand from the NT Times article that he actively involves himself in the selection process and approaches this task with relish.
Yes, empathy is our defining value down through the ages and it is why we have survived as a species. We are at our best when we act for the betterment of all.
This type of activity kills it and, as for going shopping at Walmart after killing a bunch of people, I think that’s an example of the banality of evil and it kills every soul it touches, including the triggerman.

Whenever someone wags their head and asks me, “What about the Supreme Court?” in the context of voting against Obama, I simply say,
“Sorry, but I don’t vote for war criminals who deliberately order the slaughter of innocent women and children. Since Romney undoubtedly will do the same, I’m voting for Dr. Jill Stein.”
You are correct if we are to believe the NYT article and Daniel Klaidman’s book Kill or Capture: The War on Terror and the Soul of the Obama Presidency which was published just this week: you can read an excerpt from the book in the latest Newsweek. Klaidman identifies the WH troika involved in the decision as to who is to be killed: 4-star Marine general James “Hoss” Cartwright, John Brennan, and Obama. Obama is referred to as The Decider – a tragic irony.
That is awful to learn, but there’s no way of cleaning it up. It shows what trouble both our democracy and our Freedom of the Press are in, as all commonly viewed news sources tell Americans that they must choose either Obama or somebody even worse.

Don’t be too discouraged. The digital era, of which we are now a part, has spawned a whole new generation of websites, journalists, reporters, bloggers, who are providing us a viable alternative to the traditional corporate media. FDL is a prime example of that. Though people like McCain cannot see it, Julian Assange is a digital era journalist. And a brilliant one at that.

Personally, I don’t regard any Afghan person as my enemy, if they are fighting to kick the U.S. out of their country because the U.S. has no right to be there and does not belong there.
BTW, didja know John McCain’s father was the Commander-in-Chief of the Pacific? Called CINCPAC, or somesuch. (He was also called ‘Popeye.’ A banty-rooster of a man.) I called him Nincompoop, and my father, who reported to him, practically tried to kill me in the dining room, in Hawaii, a long time ago.

I’ve seen and dealt with people who got off on killing because it made them feel powerful and that is a scary addiction to behold.

I feel ashamed of that moment of hope. I am supporting our state ACLU as an instigater/host for a Silent Auction, Cash Raffle fundraiser. With music. Because I made such a bad call and it must be counteracted by Fun and Awareness.

Not so much when defending democracy at home or taking on the real terrorists that is the Wall Street mafia or the murderers at BP.
I just finished reading the Drone Wars by Medea Benjamin. A worthwhile read about the beginnings, what is the present state and what we can expect in the future in the world of drones. Medea is a strong articulate voice in opposition to the robotic killing machines and the co-founder of Code Pink. You can read an interview with Medea here.
There is an awesome youtube video of Ms Benjamin interrupting a speech by John Brennan. Talk about speaking truth to power! What a committed and brave soul. I saw this video and she instantly became one of my heroes.
Mason, Thanks for addressing this subject. We need to keep it front and center until it stops. If anyone is interested, I also wrote a diary about the drones a few days ago. I tied the drone murders to the wrongful execution of Carlos DeLuna, who was put to death in Texas in 1989 for a murder he has recently been exonerated for.

Perry never concerned himself about much of anything except who had money to pay for the go-ahead for their pet project so he knew whose ass to kiss next. Besides, as the population of death row is predominantly people of color… aw dang, they’all prolly guilty of sumthin… let god sort ‘em out.
In the video, I especially appreciated when the guard was trying to get Medea Benjamin through the doorway. She has the heart of a tiger and the agility of a monkey and the presence of mind to go right on stating her case in the midst of the struggle. The fact that she got her concluding statement of “shame on you” in, just as they were closing the door was perfect.

Mason, I’m having difficulty with my failing eyesight this morning and wanted to provide a link to a clip from the movie Full Metal Jacket entitled Get Some over at youtube. It’s a short clip – less than 2 minutes in duration – showing a crazed side door machine gunner who is gunning down indiscriminately Vietnamese civilians. When I heard how widespread and indiscriminate our drone warfare has become I couldn’t help but see the parallel between Obama and the crazy machine gunner. Apologies for being unable to provide the link.

I would further say that this is what happened in the towns of the former Yugoslavia where people were herded out into mass graves. The fact that these assassinations become invisible as families recover their loved ones and attempt burial (though even then they are targeted) doesn’t absolve Obama of something approaching genocide. It doesn’t fit the latter category, admittedly – Obama seems to have created a category unique to himself, one of which he is undeniably proud.
Since we human beings all could be considered potential terrorists, perhaps the category is misanthropy.
I remember the film and the scene vaguely. I will find it and check it out.

I believe we are at heart empathetic people and that is why we have survived for approximately 200,000 years. We would not have survived, if we had not cooperated with each other and helped each other out.

Yes, I too weep for what we have lost, but in my more sanguine moments, I take stock and realize that much of what we have lost as a way of life needed to be lost because our lifestyles and culture of consumption were unsustainable.
Then I realize we have much more to lose before we get it and switch to a sustainable and renewable way of life.
Unfortunately, our government and those whom it serves, will stand in the way determined to hold back the sea that they can barely see from their back door.

Hey Masoninblue, was wondering if you heard about the thing in Colorado where the police surrounded and detained an entire block of cars, force them out of their cars at gunpoint, and searched them one at a time, to try and catch a bank robber.
That doesn’t sound very constitutional to me (not that unconsitutional things going on these days is anything new) and was wondering if you had written anything on it. Would love to hear your thoughts on that.

I really don’t think there’s been a time in our history when we’ve so flagrantly violated the very essence of our constitution. I really don’t.
Some claim there have always been things like this, and while I do agree there have always been those believing this is how the country should operate, I really don’t there’s been a time in our history where it was this bad, and this out in the open.
And STILL partisans on both sides can only imagine their guy winning or losing. Not understanding at all that when either one wins we all lose.
