Watt4Bob at Firedoglake posted a comment to my article, Should Mark O’Mara Withdraw as Counsel for George Zimmerman? He asked the following question, which probably is on most everyone’s mind this morning after the Sean Hannity interview of George Zimmerman last night.
I want to ask both Hannity and O’Mara what the hell good they think they did for that pathetic man, but I realize neither of them gives a damn and GZ is oblivious.
I can answer that question with three words:
EXPLOITATION. FOR. MONEY.
I am furious.
I cannot imagine myself, or any criminal defense attorney whom I respect, ever, under any set of circumstances, short of cardiac arrest, loss of consciousness or death, sitting passively beside my client as he denies any regret for killing an unarmed teenager, or anyone else for that matter, because it was “God’s plan” for him to die.
And to follow that statement with an “apology” to the kid’s parents in which he says he’s sorry they had to bury their child because he knows what it would be like to lose one of his as yet unborn children is . . . well,
What is it?
And all of this was delivered in a soft monotonous voice without any detectable trace of emotion as though he were describing doing the laundry.
Are there words that capture the depravity and emptiness of that shell of a human being?
If any of you were concerned whether the prosecution could prove beyond a reasonable doubt that George Zimmerman killed Trayvon Martin while acting with a depraved mind,, you need not worry any longer.
The prosecution must be drinkin’ the bubbly and dancin’ in the street.
I assure y’all, no client of mine would ever have said anything like that on national television with me present because I would have done something, anything, even ripped off my clothes and mooned Amerika in all my naked glory, just to shut him up.
And this appears to have been scripted.

If anyone still believes George Zimmerman is not a devious and manipulative person, please listen to this audio recording of a jailhouse telephone call when he called right-wing Pastor Terry Jones of let’s-all-of-us-sinners-party-on-the-lawn-burnin’-Korans fame to pray with him for the healing of America and ask him to cancel a pro-Zimmerman demonstration to calm people down.

Great post, Mason. It has occurred to me that maybe GZ insisted on doing the interview over MOM’s objections.
I did not watch it, and have seen only a few clips. But I’ve read that GZ claims not to have known that Trayvon was dead until an hour after he got to the police station. Leaving aside, for the moment, the fact that he told a witness to call his wife and tell her that he shot someone, let’s consider the possibilities. Certainly GZ knows that he fired his gun (in contact with Trayvon’s clothing and within inches of his chest). There are two possibilities:
A. he missed
B. he hit Trayvon
If A, then why was GZ no longer concerned about Trayvon, the fighting machine, beating up on him some more? Why didn’t he warn the witnesses and the police about the dangerous criminal who was, for some strange reason, lying on the ground without moving?
If B, then why wasn’t GZ telling the witnesses, the police, and the paramedics that there was an injured person to be treated? Why didn’t he ask about Trayvon’s condition?
His story is getting worse and worse.
Maybe there is a deep, subtle plan. After GZ is convicted, he can appeal on the basis that MOM was incompetent. The evidence for this seems to be accumulating. Or maybe they are hoping to goad the judge into yanking GZ back to jail, thereby stirring up the “supporters” and their wallets?

I’d argue that someone in the Conservative gun lobby is actually calling the shots here. Zimmerman doesn’t seem bright enough to be this manipulative and to plan this far ahead. I also sincerely doubt he has the pull to get FauxSnooze airtime on his own.
This is precisely what my wife thinks is happening. She’s been saying it for weeks.

Difficult to imagine that the topic of self-defense and STG never came up with Ostrander, an air marshal with DHS and former Seminole County Deputy Sheriff, when he was target shooting.
I caught that too. It’s obviously another lie from GZ. That law has been in place since mid 2000′s right? He obtained his concealed carry permit after the law went into effect, which means the law would have been part of any CCP/CCL classes he would’ve taken prior to getting his permit.
There have been plenty of death penalty appeals made on that basis — that the appellant didn’t get a fair trial due to incompetent representation. I’ve never heard of one that succeeded.

This is a violation of his conditions of release whereas the “apology” to Martin’s parents during the Hannity interview is sort of in a gray area.
Mind you, if I were the judge, I would issue a bench warrant for his arrest for violating the no-contact order, neither direct nor indirect, as this qualifies as indirect in my opinion.
To the extent that the judge, and it won’t be Judge Lester because he is on vacation, might be disinclined to consider his “apology” a violation of the order, reestablishing the website and twitter account is an in-your-face violation of the condition of release directing him to stay off the internet.
This is so blatant that, assuming it’s true, it makes me wonder if GZ isn’t attempting to commit suicide by cop.
In other words, violate the conditions of release in the name of free speech while in pursuit of right wing martyrdom and shoot it out on national TV with the deputies who are dispatched to arrest him on the bench warrant.
Does anyone doubt that he has managed somehow to arm himself with another gun since he got out on jail?
I hope I am wrong, but his conduct is so bizarre and irrational that I cannot help but wonder, if a scenario like this is on his mind.
If deputies are dispatched to arrest him, they better figure out a plan to deal with this potential contingency so that no one, including George Zimmerman, is killed.

I tend to think that this is a sham. Surely GZ would not set up a page on which he includes in activities “Shooting of Trayvon Martin.”
Then I have to think that GZ insisted on doing this and MOM couldn’t stop him.
On a violation like this- developing yet another web site when the conditions state not to do so, will most likely result in a warrant and immediate re-arrest. They won’t call. They will simply knock on his door.
Very unfortunate turn, I would not be surprised if a violation of release is filed soon.
It seems that you and Mason are assuming that GZ set up the website.
I think it likely that someone else did it. A friend or relative of GZ, and certainly at GZ’s behest, but that is very tough to prove.

Words (almost) fail me. That interview on fox killed any chance GZ had for a decent plea bargain. As prosecutor, I would no longer feel ANY need to deal. The best GZ could get out me now would be “Plead guilty to everything and I won’t make a sentencing recommendation”.
Is MOM setting up an ineffective lawyer appeal? Is he angry and bitter because the bail bondsman is getting the money he was going to be paid? Is he just doing what GZ tells him to do while billing by the hour?
A lawyer is supposed to protect his client from doing something like this. Even if GZ didn’t know better (he should), MOM certainly did.

I very rarely de-lurk to comment, but I wanted to say thank you Mason for your coverage and also to the fine commenters. I knew what I believed to be true about this case, but your posts and the resulting conversations have helped me to untangle my feelings from the actual. I don’t comment often, but I am always reading along. Thanks again.
Very valid points and an interesting theory. While it’s possible that MOM managed to arrange that appearence, the idea that some VIP gunlover or such made the call makes more sense.

He owned that website url. Nobody could have usurped it without his assistance. Would helping someone else set up an internet presence for GZ violate the judges order?
In any case, being locked up is the best thing that could happen to GZ right now as it will shut him up!

Even as the owner of the URL he could’ve given the necessary login information to reactivate the site to anyone. He could’ve done that before the order that prompted him to take the site down. Next to impossible for the prosecution to prove, as I mentioned above, but one could think of plausible scenarios that the defense could throw out to muddy the waters on the issue.
I think it likely that GZ passed the necessary info to a friend or family member without consulting MOM. I’m also pretty sure MOM doesn’t care. It’s kind of obvious at this point that MOM is in it for all the money he can take, and for the inroad with the neo-con gun-toting sect.
If somebody else did that and put his name on it, they really really did not do this guy any favors. At all. From my observation, the conditions of release are something that the courts absolutely do not play with. I have seen people violate time and time again, and man, is it ever ugly.
Z needs to contact O’Mara immediately and remove such a site, if it exists, because this could result in grave consequences for Mr. Zimmerman.
MOM needs to contact GZ at once, explain to him that he’s an idiot who is about to discover what a REALLY pissed judge can do, and order him to have those accounts killed.
MOM is supposed to protect him from himself.

The damage is broader than that, BoxTurtle. I didn’t watch the interview, but in the comments thread to the previous article multiple Tweets from those who were watching it were posted. They gave quite a lot of information. So, the taint goes beyond those who saw it.

Which means that somebody got wise and used a proxy registrar – one does this if one registers a domain but does not want your name, address, email, etc, plastered all over the web. There’s nothing sinister about using a proxy. But it does mean that the prosecution will have to get Domains By Proxy, to cough up the name of the registrant. That is very easily done but nevertheless …
Having got the names of the registrant(s) they now have to prove that the beneficial owner is Zimmerman and that he is therefore in breach. That’s not as easy you might think.
You should note the above applies to domains only. Twitter, facebook, blogspot, etc, are diffeerent but I’m not sufficiently well-versed in the ins and outs to be comfortable commenting.

I’m not sure anybody has a full grip on the damage GZ has done to himself and his case to date, even without this latest coffin nail.
Now that most of the prosecution’s case is open, it should have been obvious to MOM that GZ’s only hope was a friendly jury. Even if he gets aquitted, I think the Feds might come back with Civil Rights charges.
MOM has just GOT to shut GZ up. Yet he shows no signs of doing so and in fact seems to encourage these public statements.

Mason, since you mention this interview seems to have been scripted, I’d like to add that I’ve wondered if the entire incident, down to GZ’s encounter with TM, wasn’t some script running through GZ’s head.
I’d like to know if GZ had, prior to TM, ever encountered someone else he thought suspicious and how that person responded. When one is walking around their own neighborhood, or anywhere else they have every right to be, one generally greats people they meet by saying “hi”, “how ya doing”, etc. One doesn’t expect to be asked “what are you doing here?”, as I seem to remember being attributed to GZ. I’ve been wondering how I’d respond if asked such a question in my own neighborhood. I’ve concluded I might well say “none of your fuckin’ business”, simply because such a question is so far outside of normal social etiquette.
This leads me to a comment mfi made on anther thread about recall and how people aren’t necessarily good at it. However, if I recall correctly from GZ’s reenactment video, and I didn’t watch it all, GZ seemed to have perfect recall. At the time that struck me as odd and got me to wondering if GZ didn’t have some preplanned script in his head for how he would handle future encounters with “suspicious” people. If, hypothetically, previously, he’d been told to get lost when he asked someone what they were doing, he might well have come up with a plan to “handle” the next encounter with more aplomb, by his definition, and even shoot them if they questioned his authority.
Frankly, the more I know of GZ, the more likely I think it could be he, to a certain extent, preplanned TMs murder.

Millions of Americans hate Fox News and GZ’s chummy relationship with Hannity will surely make it more difficult to obtain an impartial jury. My guess is that O’Mara begged GZ not to do the interview and GZ, being the control freak that he is, ignored the advice. As for me, I couldn’t watch the interview! I mentioned on the thread last night that the state would do this. Can’t see how GZ and MOM didn’t know it would happen. According to the news last night it was a 90 minute interview but only 40 minutes were used. No doubt they are also busy issuing subpoenas for everyone involved including whomever cleaned the hotel room when the interview was over.
I didn’t think we allowed public hangings in this country anymore but there it was on the teebee last night, for all to see.

GZ needed to address somehow the accusation that he is a child molester in that interview and put it to rest.
I have not seen the interview. I have only read comments from people who have seen the interview but what I am not seeing is GZ lay to rest the accusation that he is a child molester.
Instead it seems Mark O’Mara had GZ on Hannity in order to get more money sent to his website before the news GZ is an accused child molester becomes widespread knowledge.
MOM has his own website to raise cash to defend GZ I have heard that website will be a waste of money once the news about GZ gets out.
MOM is acting in the best interest of his own fame and getting paid GZ needs a new lawyer.

Jurors sometimes lie GZ is being accused of being a Child Molester it is vary likely in such cases that jurors will lie about not having heard the accusation or that they can be impartial about it.
GZ appearing on tv and not handling this issue will hurt him even more. I think GZ and MOM both want a last internet fund raising before the news GZ is an accused child molester gets out.
However with this news deep pocket GOPers will close their wallets even the Koch Brothers, though I admit Ted Nugent might stick with GZ.

There’s a word which keeps on popping up in comments – twice so far tonight, and somewhat more often in earlier postings. That word is “insane” synonyms/variants such as “sick” also make regular appearances. IMO people are very reluctant to admit that there are quite simply people who are evil. Bad. And that it’s possible that Zimmerman is one of them. That he is not insane or sick, or deluded, or disturbed, or any of those other comforting lies that have become such a huge part of our discourse but that he’s bad through and through and is enjoying himself hugely.
Personally I’m of the opinion:
1. He’s guilty of murder.
2. He’s bad through and through and is enjoying himself hugely.
That’s my opinion based on what I’ve seen reported thus far. Despite, indeed because of that, it’s even more important that he receive a fair trial in which his guilty is established beyond reasonable doubt and he suffers retribution. If his guilt is not established beyond reasonable doubt even though we think he’s guilty as sin then he must be set free. (And yes you can have miscarriages of justice in which guilty people go free).

Seconded but GZ was with his lawyer on tv breaking the judges order so what happens to GZ’s lawyer who should have warned him breaking a judge’s order is a bad idea?
Incidentally nowhere in that interview on Fox did Zimmerman apologise for what he did. Nowhere. I’m sure he’s very sorry that he is being inconvenienced by the consequences of his actions but I see no trace of remorse for the actions themselves.

I very much agree.
I drove a taxi for sixteen years, and during that time, on average, I met about two entirely evil people each year.
People so evil that they deserve to be shot on sight.
Most people never meet anyone that fits this description, and for that, they should consider themselves lucky.
People like this make one believe in demonic possession.
When you consider that a taxi driver meets, and does business with 20 new people every day, you can see how rare truly evil people are, but they do exist.
One of the truly terrifying complications of this situation is the fact that many of these truly evil people are capable of projecting the illusion of a very charming persona when ‘necessary’.
Ok I agree with you but if my lawyer is right next to me when I’m on tv and doesn’t warn me what I and he know I am going to do next is illegal and I get arrested.
I for one would sue my lawyer and given the other mistakes MOM made telling GZ to plead indigent after MOM knew GZ had internet cash, not opposing the release of accusation’s GZ’s is a child molester and now breaking the judge’s order which very well might get GZ back in jail.
One has to wonder just how incompetent MOM is.

Here are the conditions of release, in addition to posting the @1,000,000 bond that has been posted by the bail bondsman.

I do want GZ in jail but MOM is making me worry that GZ won’t get a fair trial. I do think GZ is evil enjoyed shooting Trayvon and that GZ is also stupid enough to think he can get away with it plus he is probably insane. I would like to know what incidents led to GZ being prescribed all the medication he is on.
MOM however is none of these things and is in fact suppose to protect people like GZ from even themselves.
Instead MOM seems to love the attention and cash even though to get the attention he will likely lose this case and so far one might argue he is losing this case.

He just should have stayed in his car as instructed. GZ put himself in the position where he felt he needed to murder TM by following him.

And with what funds would you pay the lawyer to sue your lawyer? And don’t say “no foal no fee”. The other point is of course that ignorance of the law is no excuse for lawbreaking. You try to sue and I can take the implications of that a very long way indeed.

I doubt Fox News has a studio in Seminole County. I doubt a judge would approve of a person who committed perjury like GZ of going on tv Out of State to very possibly influence a jury pool.

I think I heard that the parents of Trayvon will be on Hannity tonight. I was in the car not paying attention, but I think that was the blurb.
Well If I were GZ I would have over $100,000 to sue now wouldn’t I? Plus firing your lawyer means a delay in the trial.

GZ can make many of the same claims about his lawyer and unlike GZ the lawyer should know better.
I had to ask almost beg my parole officer to go to college in another county in the same state.
I kind of do not see any judge or parole officer letting anybody in the system go out of state to possibly mess up the jury pool with lies, bad mouth the system much less a judge who GZ just tried to get thrown off the case on national tv.
So I wonder did GZ leave the state with no permission in which case he goes straight back to jail.
Or what compelled the judge to let GZ out of state?

They did the interview in a hotel in Seminole county. As to the airport, there is only one major airport in Seminole county, the Orlando-Sanford a/p. Orlando International is in a different county.

How do you know he left the state to do the interview?
He could have been interviewed remotely or they could have used a Fox affiliate in Orlando, assuming Orlando is in Seminole County and there’s a Fox affiliate there.

Use a large poster board exhibit with strips of tape across each lie and rip it back exposing the lie, the date of the lie, and the person lied to after he admits to it. Preferably use tape that makes a sound like duct tape so every person in the courtroom will forever associate that delicious sound with Zimmerman lying.

Being in trial can be a lot of fun, unless you are the witness undergoing a cross like that.
The key is to ask “yes” or “no” questions and never let him explain.
If he tries to explain, cut him off with an objection on the ground that his attempted explanation is unresponsive and move to strike it.
As needed, ask the judge to instruct the jury to disregard his attempted explanation.
Also, as needed ask the judge to order the witness to answer the question “yes” or “no.”
This man who didn’t not follow TM when advised to by the dispatcher, and doesn’t follow (presumed) advise from his lawyer to not get on national teevee etc. sounds exactly like the type of loose cannon that should be locked up with the key thrown away for the good of society.

Somehow, I cannot help but put myself in the defense team shoes and ask myself this:
On a sheet of paper divided into two columns, on the left-hand column we will write down everything we have to gain from this interview, and on the right-hand column- everything we have to lose.
I get money on the pro column, but it is money that can be made in other ways.
In the ‘con’ column, I stand to lose everything.
This was a reckless move for the defense. If I were the defense, Mr. Zimmerman would not open his mouth in public. Ever. If he opened his mouth, I would leave the case. Period. Rather, Mark O’Mara seems as reckless. As reckless as his client. This is not good.
