dlp67 commented on the blog post Can We Please Stop Pretending Obama is “Capitulating” on Social Security?
This article is a perfect example of why I love FDL and find it indispensibe reading: it’s fact-based and unflinching, even when it comes to the President.
In our culture of celebrity worship and horse-race political reporting, there’s such willingness to accept the political scripts as dictated by parties, leaders and pundits and so little attention paid to what politicians actually do and actually say. Except here on FDL.
Thanks so much for all you do to keep us informed about facted-based reality.

dlp67 commented on the diary post DHS Releases More Docs on Coordinated Efforts to Quash Occupy by wendydavis.
Wow, thanks for this. I was about to say that our era’s Cointelpro is now up and running. But I fear that in our post-911 security apparatus state, the current government surveillance and coordination system probably puts the 1960′s/’70′s effort to shame.

Thanks for this wonderful post. This is the first time I’ve heard the 5th amendment/14th amendment argument raised and argued so convincingly. This is just another reminder about why I always come to FDL first–intelligent people with fresh ideas who aren’t beholden to a political party. What a concept!!

dlp67 commented on the diary post Rescued from Real People, Boston’s De-Occupied Dewey Park Now Re-Landscaped for Passing Motorists by Scarecrow.
Pdaly, Thanks so much for your comments, defending Occupy Boston’s community at Dewey Square. After reading Scarecrow’s post, it couldn’t be clearer how amazing this encampment was and how it benefited our community. I particularly wanted to thank you for your comments about Nancy Brennan. As I type this, I’m drafting the exam for my [...]

dlp67 commented on the diary post Rescued from Real People, Boston’s De-Occupied Dewey Park Now Re-Landscaped for Passing Motorists by Scarecrow.
It’s really not an exaggeration to say that the Dewey Square “park” is a median strip with grass. Until Occupy Boston most people had never even heard of Dewey Square and certainly weren’t visiting it. When Occupy was there, in fact, it drew people there for the first time–as Scarecrow so eloquently explains, they transformed [...]

dlp67 wrote a new diary post: Occupy Boston Midnight Deadline: A Letter From Inside
Last night, when the eviction deadline for Occupy Boston arrived, I wasn’t able to make it down to Dewey Square. But I have a good friend who was able to go. Today I received this incredible letter describing what happened. When I told her how much her description had moved me, she agreed to let me post the [...] -

Yes, exactly (which shows how silly this part of the ruling was)! Assemble Boston–doesn’t quite have the same power, does it?

dlp67 commented on the diary post Occupy Boston Court Decision: Occupation is Not Speech by dlp67.
My pleasure, Scarecrow. But I have to say that your hypothetical, while interesting, doesn’t convince me. Here’s why. The current law already provides a means to deal with the “fracking as speech” hypothetical. Your hypo (like all good hypos!) certainly pushes the limits of analysis, but “fracking as speech” still could be prohibited with the [...]

“This decision is fully in line with established law.” oldgold, this is both right and wrong. You’re correct that part of this decision is arguably in line with established law. As I mentioned, part of the decision (the second part), does follow caselaw (including cases from the Warren era.) Applying that law here, the court [...]

dlp67 wrote a new diary post: Occupy Boston Court Decision: Occupation is Not Speech
As reported, Occupation Boston yesterday received word that state court Judge Frances McIntyre lifted the temporary restraining order and denied the preliminary injunction paving the way for eviction. Mayor Thomas M. Menino quickly issued a statement that the city “strongly encourages” protesters to leave Dewey Square. Although many observers had expected this result, this judge did something [...] -

dlp67 commented on the diary post THE OCCUPY BOSTON COURT ORDER: THE OCCUPATION LIVES TO SEE ANOTHER DAY by dlp67.
Thanks so much for the great post, particularly the links. And yes, I think it’s a good bet that Judge McIntyre, like most judges, likes to avoid reversal and may not want to take the strong 1st amendment stance that is so justifiable here. And one of the ways to do that–a better case scenario–would [...]

dlp67 wrote a new diary post: The Occupy Boston Court Order: The Occupation Lives To See Another Day
Since November 16 th, Occupy Boston has had the distinction of living under the protection of the state court, through a temporary restraining order prohibiting the city from deciding on its own to move to evict the occupation. Occupy Boston was back in court on Thursday, December 1 st, for the hearing to decide the fate of the [...]
