reglawyer commented on the blog post The New Obama Policy On Constitutionality Of DOMA & Boies/Olson Reaction
If I may provide some clarity, I think the administration understands that there’s no reason to set future precedents blindly, and that the people are empowered enough to demand some balance and nuance from the President.
This is a good decision. We can quibble over the next decision to enforce or unenforce as it comes up.

bmaz, you know, being an attorney out of work, I’m a little rusty. Is a Magistrate judge position a District judge?

scribe, you know, I’ve been so busy lately, and Bloch guilty to contempt of Congress almost a year ago… tell me, who’s the District Judge again?

Dear tejanrusa,
That’s a good question. While Mr. Bloch has withdrawn his plea, the DOJ has stated in its latest pleading to the court (in a footnote) that it is currently negotiating another plea bargain for a different offense.
I hope this helps.

Dear scribe,
Thank you for the suggestion. Might I make a slight change and add a Petition from the American People to submit to the Honorable Deborah A. Robinson, the Federal Magistrate Judge who is presiding over United States v. Scott J. Bloch?
Thank you for your support!
Sincerely,
David Pardo

An Open Letter from the Community of Whistleblowers to Attorney General Eric Holder Dear Attorney General Holder: We, the undersigned, wish to bring to your attention an important issue: the effective and ethical prosecution by the Department of Justice of Scott J. Bloch, a man who has gravely damaged the federal civil service. As you undoubtedly [...] -

reglawyer wrote a new diary post: Calling all whistleblowers
If you’ve had the misfortune of interacting with the Office of Special Counsel during Scott Bloch’s tenure and have something you wish to make known to the federal judge currently deciding whether to sentence him to jail, this post is for you. Making your voice heard is all the more important since the government is trying [...]

reglawyer commented on the diary post Abolishing the Senate: Yet Another Horrendously Bad Idea from Anti-Democracy Proponents by Michael Kwiatkowski.
A few things: First, the Framers didn’t contemplate the rise of political parties, which is to say the rise of partisanship, which cuts across institutional lines and creates a quasi-parliamentary system like we have today. So it’s a fiction to say that the Senate is a functioning check on the House. Sometimes it is, but [...]

reglawyer commented on the diary post Is Howard Dean Playing 12-D Chess with Obama? by merlin1963.
I agree with Dean that Obama is a reformer. He’s a pragmatist, who in the Alinsky way accepts the world as he finds it. Which means, for better or for worse, a private state based exchange health insurance system now, which will be tweaked as reality unfolds and reveals flaws in the current system. (Now [...]

Sen. Susan Collins, the Maine GOP dealmaker who’s been in the limelight this week for helping to pass a watered down stimulus, has been talking a good game about the need to avoid wasting taxpayer money. But it looks like Collins also worked today to strip from the final bill a measure that’s crucial to exposing [...]

A bill giving federal employees expanded protections against retaliation for blowing the whistle on waste, fraud and abuse died in Congress on Wednesday night, after a 12-year lobbying effort won last-minute unanimous approval for it in the House but failed to gain similar approval under special voting rules in the Senate. A single unnamed senator put a [...]

The following statement regarding the Whistleblower Protection Enhancement Act can be attributed to GAP Legal Director Tom Devine: “This holiday season, a Republican senator gave taxpayers a secret Scrooge. After unanimous House approval today, and unanimous Senate approval last month of a stronger bill, this evening an anonymous Republican senator killed the reform through a [...]

Apparently this is the 4th Congress in a row where this type of bill died at the hands of anonymous GOP holds. The last update took place in 1994, at midnight of the last day of the lame duck session (where Dems lost both chambers.)

>>“where it was stripped of its national security provisions.”; and that may be the why behind the hold. Why would someone vote against this bill after voting for one that had the natl security provisions? The Dems removed the provisions to please the GOP. It doesn’t make sense. Boehner and Hoekstra politicized the issue, trying [...]
