It is simply incorrect that anybody using open source code must make their own use of it open. It is only if used for commercial purposes or released for public use. That is, if OFA allowed the GOP to use their programming, they would have to make the underlying code public, but if OFA simply uses it for their own purposes, they do not.

One of the other injustices, beside Aaron’s prosecution, is that in most cases, the journals get the copyright to anything published in the journal (unless one of the authors is a US government employee). This means that the author(s) loses any control over the work and must pay for any copies beyond the 25 tearsheets normally provided on publication, even though ‘page charges’ are levied to actually pay for the expenses of the publication process. This often is ignored, but the journal could levy a charge (usually $25 TO $50) each copy an author sends to a colleague. No wonder most academics actually support Aaron’s ‘crime’; they are getting shafted by the journals.

If Jill Holtzman Vogel sponsored and introduced the bill (which she must have if she can strike it), you’d think she would have read it first. But that might have been too much to ask, if she is merely the state senate tool for introducing such legislation. One could hope that her legislative career has just ended, but (sigh!) probably not.

Thanks for Randall Jarrell poem. It is absolutely appalling, in the OMFG!!! sort of way. I first read this on a junior English exam taught by a published poet(a Jebbie scholastic and really good guy who left the order and later taught at Stanford) at a Jesuit high school back in 1961. You could hear the thunk of jaws hitting the floor. It is my favorite (as one might say) short anti-war poem, and makes me go huge and green and berserk whenever I think of it.
