in case he also didn’t know it, there can be NO oversight if you can’t "second guess" what lawyers do and mistakes they made, their can be NO judicial revue and NO disbarment ever if you can’t "second guess" depravity after the fact
Let’s make sure we keep this report front and center and insure it’s public release
If Yoo is not disbarred his "opinions" WILL carry the weight of presidential precedence and even though those "opinions" have been discredited, disbarment must accompany that discredit otherwise his "opinion" will demonstrate that when a president wants to destroy our country all they have to is order a lawyer to write a brief and they will have the force of law on their side

You should be hapy with Mukasey’ statement. If the best he can do is talk about the pressure, it’s indicative that no defense of the validity of the opinions is available to him.
Of course they’re incompetent; they were part of the Bush team. But we have to investigate and reach conclusions with the investigators we have, not the ones we wish we had.
And, those whose job it is to investigate such matters, people of Bush’s own team, have concluded that their team mates in the Justice Department misbehaved. That’s very, very damning.

Mukasey is making the argument here that “if you do it for the president it can’t be wrong, it can’t be illegal, it must always be considered perfect’
that’s the case making with that statement
The way to answer that gambit is to invert it: “How bad would an act taken in the heat of the moment by the administration have had to have been in order for it to have been clearly illegal and worth prosecuting?” Because the answer “Nothing would be bad enough to warrant prosecution” would be ridiculous, that brings the discussion back into the realm of the real world, and points up exactly how awful and how obviously worth prosecuting those acts really were.

Which group of Justice Dept. lawyers were blocked from gaining security clearances and had to abandon an investigation because of it, anyone remember? Wasn’t it OPR?

I don’t know how any member of any bar in this country could believe in good conscience that John Yoo should be allowed to continue practicing law. His is the kind of behavior that codes of ethics and professional responsibility are designed to punish.
