Ted Nugent is performing at Arizona ‘s Pima County Fair on the Budweiser Stage on Saturday April 28th.
I wonder if Ted, who likes to refer to himself as a law-abiding citizen, knows an important fact about the Pima County Fair?
Weapons are not allowed into the Pima County Fair, with the exception of uniformed security guards.
Pima County sound familiar? Jared Loughner killed six people and left 14 injured on the Safeway parking lot on Saturday January 8th last year. This happened in Tucson, in Pima County. U.S. Representative Gabrielle Giffords was one of the injured.
Will Nugent bring out his machine guns on stage during the show? If he does he will be going against the written directive of the Southwestern Fair Commission, Inc., a non-profit, private corporation who is paying him.
Will his security detail keep their guns locked in their vehicles?
Will they don uniforms and submit to the authority of the Sheriff of Pima County?
Or will they just ignore the Fair’s rules, strap on their guns to open carry or conceal carry?
Lately Ted has been complaining that he has to follow rules that “nobody knows about” (danger, Glenn Beck link!) You see Nugent just cut a deal for breaking the law while hunting black bears in Alaska (PDF Link to his plea to avoid jail time and $100,000 fine). I’m not a lawyer, but by reading this plea you can see that in exchange for a reduced sentence he is obligated to do certain things.
1) Be on probation for two years
2) Pay a $10,000 fine
3) Not hunt in the State of Alaska or on any United States Forest Service lands for one year
4) Make PSAs about the hunter’s responsibility for knowing the rules and regulations for the hunting activities they engage in
So now Nugent needs to REALLY pay attention to the rules, because if he fails it will breach his agreement and the United States which can them “withdraw from this agreement and may reinstate prosecution against [him] on any charges arising out of the investigation in this matter.”
I wanted to make sure that Nugent, his security staff and his roadies, knew about the weapons ban at the fair and if they would comply. So I contacted his PR person, Linda Peterson, and she said, “Of course.”‘
I asked, “So that means there won’t be people doing concealed carry backstage and he won’t be bringing any weapons on the stage?”
She said they’ll be in full compliance of the law.
There you have it folks. Nothing to worry about. Of course if anyone sees his security staff, his roadies or Nugent himself carrying weapons at the Fair they should contact Fair Executive Director Jon Baker or Launa Rabago, Marketing Manager 520-762-9100 jon or launa @ PimaCountyFair.com at the Southwestern Fair Commission about his violation of their rules. Maybe they will deduct the cost of his non-compliance from his fee.
But you should also contact his parole officer. Since I don’t who it is I’ll suggest you contact Jack S. Schmidt, the Assistant U.S. Attorney who cut the illegal bear hunting deal with Ted. Please send all backstage or onstage videos of Nugent with weapons or threats of violence toward people to jack.schmidt @ usdoj. gov. I don’t think these videos would show him violating his federal agreement, but it might show his violation of his agreement with the Fair people.
You see I want Jack to be kept informed about all the other times that Nugent knows the rules and regulations for the activities he engages in, but still violates them. It will be good for the “preponderance of evidence” for the next time Nugent “stumbles” (his euphemism for breaking the law) when it comes to weapons.
Nugent’s biggest fear is that his law breaking will lead to a felony charge that would cause him to lose his weapons. (Note to everyone: The NRA has been pushing state by state programs where violent felons can get their guns back, but it isn’t implemented everywhere–yet. “Today’s NRA: Working to re-arm violent felons for Fear and Profit.”)
Jack might also want to read Nugent’s latest post, “Ignorance of the Law is no Excuse.” It’s not his obligatory PSA, so he didn’t have to run it by Schmidt for approval, but doesn’t this article and his appearances on shows like Glenn Beck where he discusses the opposite of what he will say in the PSA mean anything? It’s like addict celebrities doing a “Don’t do drugs” PSA while joking on the Leno Show about all the coke they still do. Will people only watch court mandated PSAs and ignore what Nugent says on nationally syndicated radio shows?
When powerful people like Nugent get caught breaking the law or defying the rules that they agreed to, they pay a fine and move on like Nugent did the last time he got caught breaking the law.
Question: How many times do you get to break the law before you stop classifying yourself as a law-abiding citizen?
“I’m a serial law-breaking citizen and I carry a gun. ” Is the reality for many gun owners, but they don’t want to classify themselves that way.
Some will, however, classify other people as law-breaking and suggest they be arrested for doing or saying exactly what they have done or said. Below is Nugent on TV in 2008 with his good friend Sean Hannity saying people on the left who make threats are “reprehensible” he takes threatening comments seriously and believes people should be arrested for them.
Now, before Ted starts whining about the “lunitic left fringe trying to force him to comply to rules” I just want to state that this prohibiting of weapons at the fair is not coming from the Government. It is coming from the private corporation, the Southwestern Fair Commission, Inc. They have the right to do this. And Nugent and his agents signed a contract that said he would honor their rules. If he doesn’t honor their rules why should anyone else? What is it about breaching signed contracts doesn’t he understand?
What Happens When Someone Brings a Gun to the Fair?
If someone comes to the Pima County Fair gate and says, “I have a concealed weapon that I’d like to bring into the fair.” The staff can say, no weapons is our policy and ask them to remove the weapon and “place it in the custody of the operator of the establishment or the sponsor of the event for temporary and secure storage of the weapon pursuant to section 13-3102.01″; (link) In practice they usually are told to place them in their vehicle.
Since I wanted to know the law about what would happen if Nugent and his non-uniformed security people don’t comply I spoke to Laura Cutilletta, an attorney from the Legal Community Against Violence. It appears that if someone has refused a reasonable request from the fair staff, the staff can call the Pima County Sheriff. What will the the sheriff do?
To find out I called Dawn Barkman, the public information officer at the Pima Country Sheriff’s office. She said that if the Fair staff ask the person to comply or leave and they don’t, then the Sheriff’s office would come and arrest the person.
Arrested for what? Trespassing.
Now would the staff at Southwestern Fair Commission, Inc. want to use their resources to monitor Nugent and his staff? Probably not. They are counting on Nugent and all his staff to be reasonable people who will honor the rules and regulations they agreed to. As my collegue David Safier wrote:
I hope Nugent is willing to surrender his arms like a good, law abiding citizen. And I hope the people running the Pima County Fair are consistent enough to insist he does.
David is more of an optimist than I am. Based on observing the actions of Nugent, he and his staff will probably defy the rules with the hope that nobody videotapes them and that no one from SWFC, Inc. wants to bust them. If they are noticed and busted, they will whine about how “the Government is trying to take away my 2nd Amendment rights” instead of, “I didn’t want to follow the rules I agreed to in advance because I’m special and a serial contract-breaker when it comes to guns at the venues I perform at.”
This behavior should be noted by Jack S. Schmidt, the Assistant U.S. Attorney. but especially for all the other county fairs and festivals thinking of booking Nugent in the future.
What about the Venue’s Rights?
When a fair doesn’t book Nugent they are not violating his First Amendment rights.
A venue has a right to have policies that say no weapons. By doing so and requiring the entertainer or customers to follow those polices they aren’t violating anyone’s Second Amendment rights, they are asserting their own right to control their venue.
Based on what happens at the Pima County Fair other venues can see if Nugent defies their rules, and can decide if he is worth the hassle to book. They also need to understand that fans who attend might not follow their rules either. Yes, they say they are law-abiding, but then again so did Nugent before each of his law breaking events.
Nugent said that at 63 he won’t “stumble” (aka break the law) anymore, “Especially as a representative of the honorable hunting lifestyle and gun owners of this country.”
We’ll see.

I made a boneless duck breast with some left over maple syrup with lignonberry preserves that I used on some french toast. Added some lemon zest to cut the sweetness & fancied it up with onions, garlic & some herbs. Used fruited brandy as deglazer, and added a bit of chicken stock. I’ve been trying to use up the lignonberry preserves and am thinking the same treatment might be terrific on a venison sirloin roast I have in my freezer.
A sick aged ’70s Rocker that had some success with this oldie… Cat Scratch Fever… I swear that Fever is in it’s 4th stage with him…!

You know I grew up in a big time hunting family. My dad was a great shot. he also knew the rules when he went hunting. Real hunters appreciate the role of the game wardens and regulators.
One of our cousin’s was a butcher. When he shot a deer he took it to him to be cleaned and dressed. The butcher had just gotten a deer from some jerk hunter during bow season. He said it was strange that he had one because most bow hunters in the area weren’t having any luck. When he cut open the deer he found that the guy had first shot the deer and then stuck the arrow in the bullet hole. My cousin made sure the game warden knew about the illegal kill. I think we got part of the venison since it was forfeit to the shooter as part of the fine.

We had a gigantic buck in the neighborhood. I never saw him but he was described by one of my hunter friends and I named him Big Boy. 8-pointer I think.
Big Boy got taken out during B&A season by a jerk who both got caught poaching (killed it on the side of the road & nearby home owners saw & reported him), but he also posted his kill-pic on the internet. Got fined bigtime.
There’s another buck on the property line (hangs out betw me & my neighbor who has seen him from her kitchen window). I saw him one day last autumn in the late afternoon sun. He heard me (taking recycling out to the bin) and turned with his full glory into the setting golden autumn sun to look at me. I didn’t have binoculars but have been told he’s a 7-pointer.

When the Hollywood reporter did a story on the Fort Knox cancellation of his event there were 16,000 comments. A lot of them were complaining that his first amendment rights were being abridged and that Obama was behind it. One of the things I wanted to make clear here is that private entities have rights to regarding the health and safety of their customers. Not to mention how it would change the attitude of the fair goers.
The change of attitude is something that isn’t easy to put your finger on, but it is something that the extremists want. When they seen a group of people with out guns they don’t think, ‘That’s nice.” They think,
1) A group of people that could be in danger and need to be armed.
2) A group of people that we can sell guns to. (Gun Lobby’s view as well as NRA execs)
If the opportunity to sell guns to them goes way (because of the vetoing of the laws allowing more guns in buildings) they push the line “the world is dangerous out there” meme hard.
After school shootings they come onto the comments sections and say, Teachers should be armed. Schools are seen as “victim disarmament zones.” not as inviting places for student’s to learn.

Since I’ve come to live in the exurbs in the last several years, and have longtime god friends who are responsible hunters, I’ve had many conversations about guns. I understand & agree with everything they say.
I am not afraid of guns, but think they are not the solution to human strife and dangers.
The funny thing is that we often had access to duck, quail, geese and pheasant. But my mom didn’t really like to cook it and we kids didn’t like to eat it. One fall my uncle came over and prepared pheasant with a red wine reduction sauce. It was AMAZING. I could finally understand what “Pheasant under glass” was some kind of big deal. To me it just tasted like gamey chicken. My mom would put it into the oven and just bake it.
If my folks were still around and I was in the midwest I would be making all sorts of amazing things with my dad’s hunting successes.
That would be “good friends” not “god friends”. But interesting typo.

My friend Sara says that it is important to understand the split between the views of urban gun owners and rural hunters. My dad, big time hunter. Really didn’t like handguns. He knew they were for killing humans.
He worked with cops a lot and knew how they got used in the big city.
I have a friend who is the quintessential “responsible gun owner” we talked about the push of “Kill at Will” laws, the violent Felon re-armament program and how much he disagrees with them. He also is disgusted by how little training people need to carry a concealed weapon. That, combined with the efforts to get guns on campuses is a recipe for disaster.
I could pick up a concealed carry license by watching a one hour video.
It would be good in 35 states. I wouldn’t even have to show I knew how to use it. The NRA wants to bring this low standard to all 50 states.
My good hunter friends think that is insane. But do they push back on the NRA for pushing those laws? Not really. I think it is because the extremists are the ones who are driving the agenda.

My uphill neighbor & I went to pick up 1/4 steer (shared with a 3rd party). The couple that raised it does nothing, by their own description, but small time organic husbandry, cooking & eating. My neighbor thinks he might be a retired cop.
Anyhow, as they live in Dutchess county near some VERY VERY high end (0.0001%ers), they told the following tale. There’s a pheasant shooting range for their well-off neighbors. Not even the primitive kind where Cheney shot his friend in the face. This one, by their description, had a tower, a lackey who threw the pheasants out from it for the richie richers to shoot. Who were not interested in the meat.
LSS. The couple got free pheasant. In addition to the organic beef we paid for, we also got free boneless pheasant breasts. I prepped mine pheasant piccata. Delish.
Hawai’i is a great case study in how to deal with the ‘Gun Issue’, we have some of the most stringent Gun Laws in the Nation, and, subsequently, we have the lowest Gun Death rate…! Common Sense needs to prevail…!

Suzanne. Thanks. One of things I did while working on this story was to try and drill down to what actually happens and what lawa are actually involved. I spoke to a musician friend of mine to understand how it really works backstage. Based on what he told me, if I were to have access to backstage I could easily tell quickly if they were following the rules. I could also figure out if the Fair management people were applying the same rule to Nugent and his people as they do to the guests.
I would love to have that evidence to show the world. Most people wouldn’t be surprised, “Rocker gets away with breaking the law, what’s the big deal?” The big deal is that he’s not just some rocker, he is also on the board of the NRA and is a representative of them to the world. He has made comments that have national impact.
And he isn’t just “trashing a green room” he is actually thumbing his nose at the people who hired sponsor him because he sees his agenda a bigger and more important than theirs.
This was what Limbaugh did. He felt it was more important to push his anti-women views than to get that his sponsors have 50 women customers. But he didn’t care about them. Fine. They then had the opportunity to pull their ads.
If the other county fairs know that Nugent will disobey their rules, they have the opportunity to pull their support and cancel his show.
I wonder if any rap groups ever had shows that were canceled because some rapper wouldn’t give up his guns? Or if they felt that the audience wouldn’t honor the venue’s rules?
I am a gun owning liberal who believes the Second Amendment confers an individual right to keep and bear arms. Having said that, the Amendment also states “…well regulated…”. I apply a common sense interpretation that means the state can require training, background checks, etc. Just as there is not an unlimited First Amendment right to speech (fighting words, shouting fire in a crowded theater), there is no unlimited right to firearms.
I am less concerned about the type of weapon (revolver, semi-auto, pistol,rifle,shotgun) than I am with the morons wielding them. The latest out of Florida is but one tragic example.
I had a brief email exchange with one of my hunter friends who has a concealed carry permit. He quickly became defensive, and in the interest of ongoing friendship, stopped the dialogue.
I asked him what did he feel threatened by that he felt the need for a concealed carry. He responded that with concealed hand gun he didn’t feel threatened. That was the point I stopped asking.
I’m a dimuntive senior woman who never carried, lived in midtown Manhattan for 30+ years and never felt or was threatened. So I just don’t get it. My hunter friend is 6’4″ male, one of the best rock climbers in the U.S. in his prime. What or who could possibly threaten him?
My bee keeper concealed carries a hand gun and also has a rifle in his van. But he eats all kinds of critters and has bears to fend off. I understand his motives much more; we had a long conversation last week and he was not at all defensive about explaining what he carried & why.
By law, convicted felons may not hold a firearm. A biker gang (which the police wanted to be rid of) set up a clubhouse. The police infiltrated the gang – some had become clandestine members.
Each night, a few members would post guard duty. They would shoulder a rifle or a shotgun and walk the perimeter of the grounds.
The police were filming them. Many of the members were convicted felons. Ergo, they were breaking the law and the cops had evidence.
One day, the cops busted damn near everyone in the club. There was a biker funeral procession. The President of the club had been murdered (presumably by a rival gang).
So the arrests were made and a number of the biker felons went back to prison. The President was gone. The club dried up.
Nugent should dry up.

I have had a truly violent personal interaction with gun destruction. But don’t think for a minute that the gun was the problem. It was the human who bought it & pulled the trigger.
I used to tease my dad about hunting at those kind of places. He went a few times with his rich doctor friends. (I always wonder what doctor hunters are thinking. “All week long I have to save lives on the weekends I want to TAKE SOME!”)
The way it worked was that the guys who run the place go out to the field with some cages filled with Quail or pheasants and leave them in a location. They then come back and tell the guide the general location. They hunters then walk up and when they flush them they start shooting.
I misheard the story at first and I thought they left them in the cages.
“What, do you just go up to them in cages and shoot them?!”
Then I started thinking about the flushing process. imagining some guy thowing a cage filled with quail in the air while the hunters too turns trying to hit them.
A funny visual, but your story sounds almost like the same thing but without the cage!

Exactly, openly packing is simply ludicrous(in a Bar, Store, School, or otherwise), and even concealment permits need to be seriously scrutinized and well justified…!

Interesting. I was stunned when I found out about the movement to get people with violent felonies their guns back. I liken than push and the push to “allow” (which will become defacto mandated) guns at schools to the push of the “Kill at Will” laws in Florida and 25 other states.
It is all happening under most people’s radar. When I talk to teachers about this movement they laugh. Then I tell them the states where it is happening. Until the Trayvon Martin shooting few knew about these changes.
When we see a high profile shooting of someone carried out by a violent felon who legally go their gun back people might notice.

I had a really good conversation with beachpopulist on some of these issues awhile back. I appreciated his willingness to drill down to the ludicrousness as it were.
How some people see the world really has an impact on what they do. I know it impacts me. Also if you feel that the solution to gun violence is more guns, you are not going to be considering other options.
Fear is a very powerful driver, and if you want to use it to see guns or insurance you can be both subtle or overt. But you know your goal, more guns. Convince people that MORE guns will make you safer.
Data that opposes that view is to be questioned. They appeal to the individual feeling of the person who is afraid. If you get this gun, your fears will be lessened. You will fill more powerful. Your penis will get bigger.
If someone tries to take away your gun then it stands to reason you will lose your power, your fears will come back and your penis will shrink. Therefore even reasonable sounding things have to be called “gun grabbing” (penis grabbing?) so as to invoke the fear.

Selective Enforcement is pending in the Nuge Matter. OWS gets their skulls cracked by police; Mexicans get tazed, beaten and killed by police on the border; NRA-friendly Gabby Giffords gets maimed. Nuge gets to bring guns onstage and fire up the base. Rules? What rules?

I’m coming from the perspective that a lot of lefty fear of guns stems from never knowing and never actually having an in-depth conversation with a responsible gun owner.
I wouldn’t go to a concert where people were allowed to carry guns. I don’t like that kind of music anyhow, but I wouldn’t go to a Shakespeare perf where gun owners were allowed to show up.
Like with economics (which I never address anymore since I’ve typed all I care to on that subject), there is good, sensible regulation of guns, irrational fears, hidden agendas, and all the possibilities in between wrt guns.
U.S., in all subjects, seems to be completely into the irrational end of this distribution.

I am truly sorry you had that experience. It is a shocking and life-changing experience, and my heart goes out to you.
I do not go looking for trouble and I pray that I never have to resort to a maximum self-defense. It would have to be a no-option scenario, and I know that even being in the right, I’d never be the same.
I do enjoy hunting with a select few of my buddies. At my age, it is more about getting away from the rat-race, but we do take a few wood ducks and the occasional deer. Wild duck a l’orange is something else!
Sadly, there are a lot of folks with poor judgement/impulse control that are packing. There is no short-term answer to that. I am all for bringing the full hammer down on gun abuse – illegal sales, crimes committed with guns, etc, as well as rigorous training requirements.

Exactly. Not that you need to talk about economics, but my friends who write on the topic like to show me stats about how much money there is to be made in the gun selling business. And if the younger people aren’t as interested well what do you do? Ramp up the fear to sell more guns.

Since this is a rule imposed by a private organization and not a law being enforced by Pima county or the state of Arizona, I don;t see how carrying a weapon violates his probation, unless not carrying firearms was one of the conditions. Remember Pima County has a birther for a sheriff and those people just lurvs them some Nugent. Don’t you realize that wingers don’t have to follow the same rules they impose on everybody else? It’s one of the perks they give themselves for being wealthy.
