Weekly Mulch: Chevron Must Pay; GOP Tries to Gut the EPA

An Ecuadorian judge ordered Chevron this week to pay $8.6 billion in damages for polluting the Amazon rainforest from 1964 until 1990. The payout is the second largest ever in an environmental case, with only the damages BP agreed to pay in the wake of last summer’s Deepwater Horizon spill being higher.

Environmental lawyers and advocates hailed the case as a landmark victory, but as Rebecca Tarbotton reports at AlterNet, Chevron is still planning to fight the case.

“In fact, the oil giant has repeatedly refused to pay for a clean up even if ordered to by the court,” she writes. “In one chilling statement, Charles A. James, Chevron’s vice president and general counsel, told law students at UC Berkeley that Chevron would fight ‘until hell freezes over, and then skate on the ice.’”

The Cost of Doing Business

Chevron can continue to fight the case because it’s cheaper for them to fund their lawyers than to cough up billions. Like so many environmental issues, this one comes down to money, which environmentally destructive corporations always seem to have and activists, regulators, and victims simply don’t.

In Washington, the newly empowered Republican Party is doing its darndest to make sure that remains the case. It’s budget season, and the Environmental Protection Agency is one of the prime targets for cutting in Republicans’ budget proposals. Kate Sheppard reports at Mother Jones that House Republicans are not only trying to take away $3 billion from the agency, but also are pushing to bar the EPA from regulating carbon or other greenhouse gasses. Putting this in context, Sheppard writes:

The National Wildlife Federation says the cuts amount to a “sneak attack” on existing environmental laws like the Clean Air and Clean Water Acts, because they would make it basically impossible for the EPA to do its job. The huge cut—the biggest in 30 years—”would jeopardize the water we drink and air we breathe, endangering the health and well-being of all Americans,” Gene Karpinski, the president of the League of Conservation Voters, said Monday.

The need for green

But environmentalists have their backers, too. At Grist, Bill McKibben, the author and climate activist who co-founded the climate group 350.org, has an interesting look at how the Sierra Club’s National Coal Campaign, led by Bruce Nilles, banded together with other environmental activists to successfully shut down proposals for coal-fired power plants across the country. One of the keys, of course, was money:

A consortium of foundations led by the Rockefeller Family Fund helped provide not only resources for the fight but crucial coordination. By the summer of 2005, RFF’s Larry Shapiro, David Wooley from The Energy Foundation, Nilles, and others formed a loosely organized “coal cadre.”

The coordination was crucial not only for the advocacy groups involved, which each have different strengths and geographical bases, but for the money men as well:

“I first went to Florida in 2005 to meet with several groups fighting coal plants,” said Shapiro. “I thought I would figure out who we could give $50,000 to. After my trip, I realized it wasn’t a $50,000 project — it was a million-dollar project. Over time, the Energy Foundation and others got into the game, so we ended up with some real money.”

In the end, McKibben reports, RFF gathered together, from its own pockets and from other foundations, $2.8 million.

Windfall

On top of the type of advocacy work that McKibben details, there’s another reason why more communities and companies are moving away from coal-fired power plants: they have a choice. Plants fueled with natural gas are a popular alternative, but as Gina Marie Cheeseman writes at Care2, in some areas, onshore wind power can compete with coal on costs.

“In some areas of the U.S., Brazil, Mexico and Sweden, the cost of wind power ($68 per megawatt hour) generated electricity is competitive with coal-fired power ($67 a megawatt hour),” Cheeseman writes. Wind power is also, she notes, competitive with natural gas, according to the American Wind Energy Association.

Close to home

These sort of adjustments make it easier for consumers to make sustainable choices. And in the end, personal choices do impact the amount of carbon humanity is spewing into the atmosphere. As two recent European studies showed, men make choices that generally produce more carbon emissions than women, Julio Godoy reported for Inter Press Service.

One study focused on France, the other on Germany, Greece, Norway, and Sweden. The second study, conducted by researchers at the Swedish Defence Research Agency, found that men ate more meat, drank more processed beverages, and drove more frequently and for longer distances. Annika Carlsson-Kanyama, one of the study’s authors, has argued that their results apply more broadly, too.

“These differences are not specific to the four countries studied, but are generalised across the European Union and have little to do with the different professional activities of men and women,” she told Godoy.

Weekly Mulch: The Dirty Truth about Natural Gas and Energy Innovation

The argument against natural gas got a boost this week, when a congressional investigation turned up evidence that oil and gas companies were using diesel gas to extract gas from the ground.

Natural gas companies have insisted that their newly popular hydraulic fracturing (known as “fracking”) techniques are safe, but as Care2’s Kristina Chew reports, “environmentalists and regulators have become increasingly concerned that the fracking chemicals—including toluene, xylene and benzene, a carcinogen, which are all from diesel gas—are seeping out into underground sources of drinking water, in violation of the Safe Water Drinking Act.”

The mix-up

The Environmental Protection Agency is conducting an inquiry into the environmental impacts of fracking, and some states are considering more stringent regulations of the practice, including disclosure of the chemicals that go into fracking fluid. Gas companies have argued that the blend of chemicals is a trade secret and must be kept private, but the findings of the congressional investigation suggest otherwise. Eartha Jane Melzer reports at The Michigan Messenger, “In a letter to EPA administrator Lisa Jackson… Reps. Henry Waxman, Edward Markey and Diana DeGette reported that although the EPA requires permits for hydraulic fracturing that involves diesel none of the companies that admitted using diesel have sought or received permits.”

And, as Melzer reports, diesel is the only chemical used in fracking that’s currently regulated under the Safe Drinking Water Act. That companies have been sneaking it into the ground does not strengthen the industry’s case for independence.

Ensuring that natural gas companies do their work without threatening water supplies is becoming ever more crucial, as the fuel becomes one of the go-to replacements for coal. In Massachusetts, for instance, some legislators are pushing for a coal plant in Holyoke to start using natural gas or renewable energy, rather than being shut down, as Nikki Gloudeman reports at Change.org.

Supporting renewables

And although renewables are thrown in there as an option, right now the clearest way to replace the amount of energy generated by coal is natural gas. This year’s line on energy policy from Washington, however, is that the country should support innovations in clean energy.

Will Obama’s new direction on this issue go anywhere? Grist’s David Roberts has been arguing that any energy policy that leaves out climate change is missing the point.

However, Teryn Norris and Daniel Goldfarb (also at Grist), of Americans for Energy Leadership, a California-based non-profit, have a smart rebuttal. They argue that clean energy needs the boost in research and development that Obama is promising. Ultimately, they, write, “these investments will drive down the price of low-carbon energy and pave the way for stronger deployment efforts — perhaps even including a strong carbon price at some point — both here and in the developing world, where the vast majority of future emissions will originate.”

But, about climate change!

And to be fair, the federal government is trying to lead the way on investing in renewables. As Beth Buczynski reports at Care2, the Department of Energy is working on a $2.3 million solar energy project that would power its Germantown, Md., location.

Not every one is willing to wait for investments to take hold, however. On the National Radio Project’s show, “Making Contact”, Andrew Stelzer examines what climate activists are doing, post-Cancun, to push forward debates on climate change. Ananda Lee Tan, Global Alliance for Incinerator Alterantives argues, for instance, “Community-led climate justice in the U.S. has been winning. The largest amount of industrial carbon that has been prevented in this country has been prevented  by community-led groups, grassroots groups fighting coal, oil and incinerators.”

Cause and effect

Whether the solution comes from industry, government, or grassroots groups, the country’s energy policy will change over the next few decades. And what’s troubling is that it’s not clear what the impact will be. Take natural gas: Washington favors it right now because it’s thought to have lower carbon emission than coal. But any time humans introduce new factors into the environment, they can have unexpected consequences.

That’s not only true for the energy industry, too. In Texas, for instance, the government is trying to eradicate an invasive plant species, a type of giant cane called Arundo that is growing all over the Rio Grande Valley. As Saul Elbein reports for The Texas Observer, it’s been hard to eradicate:

There are three primary ways to control invasive plant species: Kill them with herbicides, clear them with bulldozers and machetes, or attempt to introduce a new predator. The least controversial approach, clearing the cane, is not going to work. There are thousands of square miles of the stuff, and Arundo cane is nearly impossible to cut out. Each stalk has a thick taproot that sends shoots in every direction. You can bulldoze or chop the cane down, and it will grow right back. Worse, any stress on the plant—say a machete blow—causes it to send out more root stalks. Every chopped-up joint of cane that floats downstream can sprout another stand.

But, Elbein reports, scientists have come up with a different solution: They’ve bred wasps that originate in the same region as the cane to come in and eat it. They’ve also taken precautions that the wasps won’t have their own adverse impact on the environment by ensuring that they can only survive on this particular type of plant. But even then, it’s a tricky business.

“The wasps have to survive,” John Adamczyk, an entomologist running the project, told Elbein.  “They have to not all get eaten. Then it becomes a question of whether they can keep the cane in check.”

Weekly Mulch: Coal Ash in Our Stockings

It’s the naughty children who get coal in their stockings, and it seems like Americans must have been naughty this year. Because across the country, we’re awash with coal, carcinogens, and other toxins. And our government is not doing to much to change that.

Waste not

After the massive coal ash spill in Tennessee two years ago, the EPA began working on more stringent regulation of the waste, a byproduct of coal mining. But, as Kate Sheppard reports at Mother Jones, the industry has been pressuring the administration to adopts weaker regulations than it could.

“Two years after the largest toxic spill in the nation’s history, there is still no regulation of deadly coal ash dumps—nor is there clear direction from EPA on the timing or content of a final rule,” Lisa Evans, senior administrative counsel for Earthjustice, told Sheppard.  “For the communities enduring damage from aging ponds and leaking landfills, time has run out. There is no reason on earth that their health should be compromised by such an easily avoidable harm.”

What’s in the water?

Coal ash is one of those pollutants that clearly poses a problem. It looks dangerous. But not all pollutants are so obviously dangerous. This week, for instance, the Environmental Working Group, an environmental health non-profit group, released a report showing that much of the country’s tap water is contaminated with the carcinogen hexavalent chromium, with levels high enough to pose a risk to human health.

“Exposure in tap water has been linked to cancers of the stomach and gastrointestinal tract in both animals and people,” Rebecca Sutton, a scientist for the Environmental Working Group, wrote at AlterNet. Thirty-one of the 35 cities that the group examined had dangerously high levels of the contaminants in the tap water.

How did this happen? As Sarah Parsons explains at Change.org, “The reason so much chromium-6 winds up in tap water is that industries spew it into waterways, utilities fail to test for the substance, and the EPA doesn’t regulate it in drinking water.”

What the EPA does do, Parsons reports, is limit the total chromium in drinking water, “the combined amount of hexavalent chromium and trivalent chromium.” She explains, “The problem is that trivalent chromium is actually good for you—in fact, it’s necessary for metabolism. Hexavalent chromium, on the other hand, is a noxious carcinogen.”

Moving forward

These prevalent toxins are just two reminders that, for all their successes in recent decades, environmentalists still have much work ahead of them. How should they approach that work? Earth Island Journal’s Jason Mark, considering lessons from the 1980s-era environmental leaders, who focused on moving toward the center and working within the confines of D.C. politics, offers this thought: “The new leaders of 2010 say what we need is less focused group messaging and inside-the-Beltway maneuverings, and more heartfelt spirit and energy directed encouraged at the grassroots. I hope their instincts are right. Because at this point I don’t think we can wait another 25 years to figure this stuff out.”

Weekly Mulch: What’s in Your Water? Nuclear Waste, Coal Slurries and Industrial Estrogen

It won’t be long before the world has to confront its diminishing supply of clean water.

“We’ve had the same amount of water on our planet since the beginning of time, ” Susan Leal, co-author of Running Out of Watertold GritTV’s Laura Flanders. “We are on a collision course of a very finite supply and 7.6 billion people.”

What’s worse, private industries—and energy companies in particular—are using waterways as dumping grounds for hazardous substances. With the coal industry, it’s an old story; with the natural gas industry, it’s a practice that can be nipped in the bud.

In many cases, dumping pollutants into water is a government-sanctioned activity, although there are limits to how much contamination can be approved. But companies often overshoot their pollution allowances, and for some businesses, like a nuclear energy plant, even a little bit of contamination can be a problem.

Business as usual

Here’s one troubling scenario. At Grist, Sue Sturgis reports that “a river downstream of a privately-owned nuclear fuel processing plant in East Tennessee is contaminated with enriched uranium.” The concentrations are low, and the water affected is still potable. The issue, however, is that the plant was not supposed to be discharging any of this sort of uranium at all. One researcher explained that the study had “only scratched the surface of what’s out there and found widely dispersed enriched uranium in the environment.” In other words, the contamination could be more widespread than is now known.

Nuclear energy facilities must take particular care to keep the waste products of their work separate from the environment around them. But in some industries, like coal, polluting water supplies is routine practice.

The dirtiest energy

In West Virginia, more than 700 people are suing infamous coal company Massey Energy for defiling their tap water, Charles Corra reports at Change.org. In Mingo County, tap water comes out as “a smooth flow of black and orange liquid.” Country residents are arguing that the contamination is a result of water from coal slurries, a byproduct of mining that contains arsenic and other contaminants, leaking into the water table. Residents believe the slurries also cause health problems like learning disabilities and hormone imbalances, as Corra reports.

Newfangled notions

Even so-called “clean coal,” which would inject less carbon into the atmosphere, is worrisome when it comes to water. The carbon siphoned from clean coal doesn’t disappear; it’s sequestered under ground. For a new clean coal project in Linden, NJ, Change.org’s Austin Billings reports, that chamber would be 70 miles out to sea. As Billings writes:

The plant would be the first of its kind in the world, so it should come as no surprise that the proposal is a major cause for concern among New Jersey environmentalists, fishermen, and lawmakers. According to Dr. Heather Saffert of Clean Ocean America, “We don’t really have a good understanding of how the CO2 is going to react with other minerals… The PurGen project is based on one company’s models. What if they’re wrong?”

In this case, it wouldn’t only be human communities at risk (“Polluted Jersey Shore,” anyone?), but the ocean’s ecosystem.

Frack no!

Coal communities in West Virginia have been dealing with water pollution for decades. But a another source of energy extraction—hydrofracking for natural gas—has only just begun to threaten water supplies. Care2’s Jennifer Mueller points to a recent “60 Minutes” segment that explores the attendant issues: it’s a must-watch for anyone unfamiliar with what’s at stake.

Fortunately, some of the communities at risk have been working to head off the damage before it hits. In Pittsburgh this week, leaders banned hydrofracking within the city, according to Mari Margil and Ben Price in Yes! Magazine. They write:

As Councilman [Doug] Shields stated after the vote, “This ordinance recognizes and secures expanded civil rights for the people of Pittsburgh, and it prohibits activities which would violate those rights. It protects the authority of the people of Pittsburgh to pass this ordinance by undoing corporate privileges that place the rights of the people of Pittsburgh at the mercy of gas corporations.”

Environmentalists in other municipalities, in state government, and in Congress would do well to follow Pittsburgh’s lead.

Mutant fish

Of course, you can’t believe every tale of water contamination you hear. At RhRealityCheck, Kimberly Inez McGuire takes on the persistent myth that estrogen from birth control is making its way in large concentrations into the water supply and leading to mutations in fish.

This simply isn’t true. As McGuire explains, “The estrogen found in birth control pills, patches, and rings (known as EE2) is only one of thousands of synthetic estrogens that may be found in our water, and the contribution of EE2 to the total presence of estrogen in water is relatively small.” Where does the rest of the estrogen come from? Factory farms, industrial chemicals like BPA, and synthetic estrogen used in crop fertilizer. So, yes, the water is contaminated, but, no, your birth control is not to blame.

Greening the US

Stories like these, of environmental pollution by corporations, seem to come up again and again. They’re barely news anymore and so easy to ignore. But it’s more important than ever for environmentalists to fight back against these challenges and push for a green economy that minimizes pollution. The American Prospect’s Monica Potts recently sat down with The Media Consortium to explain the roadblocks to a green economy. Weekly Pulse: Anti-Masturbation Crusader Christine O’Donnell is Master of Her Domain

Christine O’Donnell is master of her domain. The deeply conservative Tea Party darling won the Republican senate nomination in Delaware last night with a stunning upset of establishment favorite Rep. Mike Castle.

O’Donnell rose to prominence as an anti-masturbation crusader in the 1990s. Jillian Rayfield of Talking Points Memo has video of O’Donnell’s 1996 appearance on MTV’s series "Sex in the Nineties" in which she and her colleagues from the Savior’s Alliance for Lifting the Truth Ministry. (SALT) O’Donnell warns teens that masturbation is adultery that will undermine their future marital sex lives: "You’re going to be pleasing each other, and if he already knows what pleases him and he can please himself, then why am I in the picture?" she asks.

Lest you think the anti-masturbation ministry was a youthful indiscretion, O’Donnell was still listed as the contact person for SALT on a web directory last updated in 2009. Christina Bellantoni of TPMDC reports that O’Donnell remained an outspoken social conservative on the campaign trail.

Blessing in disguise?

Suzi Khimm of Mother Jones sees O’Donnell’s victory as a potential blessing in disguise for Democrats:

Ultimately, though, the biggest benefactor of an O’Donnell victory could be the Democratic Party, as she has a significantly weaker shot against the likely Democratic contender, lawyer and county executive Chris Coons. [...] If the GOP loses Delaware, it could completely blow its chance at getting enough seats for a Senate majority.

Adele Stan of AlterNet reports that, as of 3 o’clock on Wednesday morning, former New Hampshire Attorney General Kelly Ayotte was still locked in a dead heat with Tea Party favorite Ovide Lamontagne for the Republican Senate nomination. Does Ayotte’s name sound familiar? That’s probably because she made a name for herself as the anti-abortion Attorney General behind Ayotte vs. Planned Parenthood of Northern New England, Beth Saunders reports for RH Reality Check.

If either of these Republican nominee proves too extreme for the voters of New Hampshire, the Democrats could pick up the senate seat being vacated by Republican Judd Gregg.

Urban coal pollution is deadly

In other health news, Michelle Chen reports in Colorlines that coal pollution will kill 13,000 Americans this year, mostly in urban areas:

According to the study, fine particle pollution linked to the coal industry is “expected to cause over 13,000 premature deaths in 2010, as well as almost 10,000 hospitalizations and more than 20,000 heart attacks per year.” The estimated death toll clusters in certain industrial cities, namely New York, Philadelphia, Chicago, Pittsburgh and Washington, D.C., affirming other research showing the racial and economic implications of these urban health impacts.

The bright side is that fewer people are projected to die of coal-related illnesses this year compared to last year. It’s not clear whether we have tougher regulation to thank, or the economic slowdown, or both.

Weekly Mulch: Obama’s Responsibility for the BP Oil Spill

President Barack Obama is in Louisiana today, and BP is saying it will know in 48 hours if its attempt to “top kill” the leaking oil well in the Gulf Coast by pouring mud and cement over it has worked.

If the scramble to stop the leak has ended, the slog to clean up is just beginning. Thousands of fisherman are still out of work, as ColorLines notes. But there are new jobs in Louisiana. This week Mother Jones’ Mac McClelland visited workers raking oil off a beach in Louisiana. One man, she writes, “can’t count how many times he’s raked this same spot in the 33 hours he’s worked it since Thursday, but one thing he’s sure of, he says, is that he’ll be standing right here tomorrow and the next day, too.”

Next moves

Although the regulatory infrastructure that was supposed to oversee companies like BP failed in this case, the administration is stepping up to ensure that the spill is stopped and the clean-up begun. “I take responsibility,” the president told reporters yesterday. "It is my job to make sure everything is done to shut this down."

Kevin Drum calls this performance and the media affirmation that came after it “the kabuki of our times”—a show that only pretends that the government has the wherewithal to stop the leak without the resources of private industry.

“The president has to be In Charge whether he can actually do anything or not,” Drum writes. “What everyone should be asking is not what the feds are going to do about capping the leak, but what they’re going to do to make sure all the oil is cleaned up afterward.”

Going forward, the government needs to make sure that BP fulfills its clean-up promises. Without strong oversight, the company could slip out of paying its debts. That’s what happened last time an energy company left a lake of oil in American waters, as Riki Ott’s Not One Drop documents. The book “describes firsthand the impacts of oil companies’ broken promises when the Exxon Valdez spills most of its cargo and despoils thousands of miles of shore,” according to Chelsea Green.

BP’s behavior

BP has little incentive to clean up its operations or to take responsibility for the damage it has already incurred. As Care2 reports, another BP rig had to shut down this week when a power outage caused crude oil to spill from its storage tank to “secondary containment.” And on the Hill, Rep. Ed Markey (D-MA) charged that the company was deliberately low-balling its estimates of the Gulf spill’s size to avoid additional fines.

At The American Prospect, Monica Potts delves into the logic behind BP’s operations. Even when using one of the highest estimates of the spill’s volume—70,000 barrels a day, or more than 2 million barrels overall—she writes, “Americans burn about 10 times that, 21 million barrels, each day. It would only take us a couple of hours to use up everything in the Gulf. This is despite everything we know about how bad burning oil is. Given that, it’s not surprising that an oil company might rank our desire for oil more highly than our undemonstrated desire to avoid ecological disaster.”

Environmental obscenities

In Texas, activists tried this week to demonstrate to BP that consumers do desire to avoid such disasters, AlterNet reports. A group of women traveled to the company’s headquarters and, wearing little more than sandwich boards, tried to expose “the naked truth about drill, baby, drill.”

AlterNet reports that Diane Wilson, who organized the protest “doesn’t take nudity lightly.” Growing up in rural Texas, “I was taught that flesh is sinful, it’s the devil,” she said. “So for me, using nudity to expose the truth about BP was WAY outside my comfort zone. But I realized that it’s the destruction of our ecosystem by corporate greed that’s obscene, not a woman’s body.”

Real responsibility

It’s important to realize that such destruction is not limited to this one catastrophe in the Gulf. As David Roberts writes at Grist:

“We don’t get back the land we destroy by mining. We don’t get back the species lost from deforestation and development. We don’t get back islands lost to rising seas. We don’t get back the coral lost to bleaching or the marine food chains lost to nitrogen runoff. Once we lose the climatic conditions in which our species evolved, we won’t get them back either.”

Fixing the system

If Obama is ready to take responsibility for the oil spill, he might want to focus on strengthening the government regulators who oversee these dangerous industry. The lack of oversight from the Minerals Management Service—which was rotting from the inside-out long before Obama came into office, TPM reports—played a huge role in this spill. Across the country, the government bodies that are supposed to be guarding the environment have stepped away from that responsibility.

Consider, for instance, Forrest Whittaker’s report in The Texas Observer about his state’s environmental oversight agency. “In decision after decision, the Texas agency that’s supposed to protect the public and the environment has sided with polluters,” Whittaker writes.

President Obama may not be able to fix Texas’ problems, but he can provide leadership by correctly regulating corporations that pollute. In that way, the president can take responsibility not just for cleaning up this spill, but for preventing the next one.

Weekly Mulch: Why the Senate Climate Bill is Doomed

Sen. John Kerry (D-MA) and Sen. Joe Lieberman (I-CT), though down one man, finally released their stab at climate legislation this week. One of the most crucial sections in the bill covers off-shore oil drilling, an issue that was supposed to help solve the tricky math of reaching 60 votes. But since the Deepwater Horizon rig sank in the Gulf of Mexico, drilling has become a wedge issue.

Just a few weeks ago, off-shore drilling could have been a point of compromise around which Senators could rally votes to pass the climate bill; now the bill had to strike a new balance to mollify both potential allies who oppose drilling, like Sen. Robert Menendez (D-NJ), and those who support drilling, like Sen. Mary Landrieu (D-LA). The draft that Sen. Kerry and Sen. Lieberman released this week allows for expanded drilling but gives states veto power over new projects.

Sen. Lindsey Graham (R-SC), who worked on the bill, said that he had not seen the changes his two colleagues had made since he dropped out of the drafting process—but he looked forward to reviewing their work. Although Sen. Kerry says he thinks the bill can pass, without support from Sen. Graham or another Republican, chances are slim.

Next steps

Now that the two Senators have released the bill, the only work that remains is to pass it.

“I think climate change legislation is dead,” writes Kevin Drum at Mother Jones. His explanation:

“There’s not enough time for a bill to go through the committee process, get passed by the Senate, sent to conference, amended, and then passed by the full Congress before the midterms, and after the midterms Democrats will probably be reduced to 53 or 54 members in the Senate.”

Not everyone agrees that the bill’s chance are so dire, though.

“I think the chances are roughly as good as they’ve ever been in the Senate: low but non-trivial,” says Grist’s David Roberts.

Kerry’s argument

But should green-minded politicos root for the bill’s passage at all? Sen. Kerry and Sen. Lieberman worked closely with energy companies while drafting the bill, and the resulting legislation balances the need to reduce carbon emissions with the interests of prime polluters. The bill includes incentives for old energy industries like coal and natural gas, for instance, and exempts farmers from carbon caps.

On Wednesday, Sen. Kerry made his case to left-leaning environmentalists. “A comprehensive climate bill written purely for you and me — true believers — can’t pass the Senate no matter how hard or passionate I fight on it,” he wrote for Grist. The bill they have, he wrote, can pass, and that victory outweighs the compromises in the legislation.

Responses from the left

On Democracy Now!, Phil Radford, the executive director of GreenPeace USA, said that most environmental groups have given the bill little more than a “tepid endorsement.” Radford squared off on the show with Joseph Romm of the Center for American Progress, who supports the bill.

“This will be the first bill ever passed by the Senate, if it were to pass, that would put us on a path to get off of fossil fuels,” Romm said.

The two men were also divided over issues like the impact the climate bill could have on international negotiations.

They agreed, though, there is room for improvement; the only question is whether the politics of climate change will allow for the passage of a stronger bill any times soon. As Kevin Drum wrote, “If you think this year’s bills are watered down, just wait until you see what a Congress with a hair-thin Democratic majority produces.”

Coal and natural gas

Tripping up environmentalists now, though, are the hand-outs to dirty energy industries. The coal and natural gas industry could both benefit from the provisions of the Senate bill, for instance.

On GritTV, Jeff Biggers, a writer and educator who covers the coal industry, explained his frustration:

“The climate bill is a nice first step and a very well meaning effort for someone like Sen. Kerry who’s been working on this issue for 20 years. But at the same time, because of the massive big coal lobby that has poured millions of dollars into lobbying congress on this climate legislation…there are all sorts of little panders and loopholes and exemptions.”

“What we see in this bill is that Sen. Kerry and Lieberman want to ensure coal’s future,” he said.

The booming natural gas industry also had a hand in shaping the bill and benefited from it. Environmental groups like the Sierra Club favor natural gas as an energy source over coal, and as Kari Lydersen reports in Working In These Times, the industry is driving job growth at a time when the economy needs a boost.

But as Alex Halperin reported last month for The American Prospect, in the places where drilling is occurring, like Ithaca, NY, activists are arguing that the environmental risks could outweigh those economic benefits.

Drill or be drilled

That devil’s bargain—risking natural resources for jobs in the energy industry—went the wrong way for the Gulf Coast, and states like Louisiana, Alabama, and Florida are paying the price even before the oil hits shore.

As I report in AlterNet, the Gulf’s economy could lose billions of dollars and is suffering already from the misconception that its beaches are tarred with oil. With this catastrophe still fresh in voters’ minds, the Senate climate bill proposes pushing new drilling initiatives 75 miles offshore and giving affected states veto power over these projects.

Depending on how long the memory of the Deepwater Horizon spill lasts, politicians could have a good reason to veto drilling. Public News Service reports that 55% of Floridians now oppose off-shore drilling, “almost a complete reversal from one year ago.”

Blame game

Certainly no one is stepping up to take responsibility for the explosion off the coast of Louisiana, as the Washington Independent reports. At a hearing this week, officials from British Petroleum, which was operating the well, Transocean, which owns it, and Halliburton, which was doing contract work that may have caused the problem, all denied wrongdoing and pressed the blame on each other.

It’s starting to look Halliburton played a key part. “The focus is increasingly shifting to the role of Halliburton, which poured the cement for the rig, as well as for another operation that spilled oil off the coast of Australia last August,” writes Kate Sheppard at Mother Jones. The company apparently did not place a cement plug that would have kept gas in the well before emptying it of the mud that was holding in the flammable gas.

Anyone living in a state that could have new drilling off their coast should keep this catastrophe in mind if their politicians are given the option of vetoing new projects.

Weekly Mulch: Massey Energy coal costs the environment

Coal consumption has costs — this week’s explosion at a West Virginia mine, which killed 25, made that clear. Those costs aren’t limited to human lives, either. Massey Energy Co., the owner of the West Virginia mine, has racked up not just safety violations but also consistently has disregarded the environmental effects of its work.

Black marks on Massey’s record

This week’s explosion is far from the first debacle associated with a Massey project, and past incidents have had disastrous impacts on the environment. In 2000, a break in a Massey-owned reservoir, filled with coal waste, caused more damage than the Exxon Valdez spill, Steve Benen writes at The Washington Monthly. Clara Bingham described the flood of sludge for the magazine in 2005:

“The gooey mixture of black water and coal tailings traveled downstream through Coldwater and Wolf creeks, and later through the river’s main stem, Tug Fork. Ten days later, an inky plume appeared in the Ohio River. On its 75-mile path of destruction, the sludge obliterated wildlife, killed 1.6 million fish, ransacked property, washed away roads and bridges, and contaminated the water systems of 27,623 people.”

A year later, another 30,000 gallons of sludge poured into a river in Madison, WV, “with nary a peep from Massey,” Kevin Connor points out at AlterNet.

The company routinely scorns environmental regulations, too, asAndy Kroll reports for Mother Jones:

“Between 2000 and 2006, Massey violated the Clean Water Act more than 4,500 times by dumping sediment and leftover mining waste into rivers in Kentucky and West Virginia, the EPA said in 2008. (Environmental groups say the EPA’s tally is a lowball figure; they estimate that the true number of violations is more than 12,000.) As a result of these breaches of the law, the company agreed to pay the EPA a $20 million settlement.”

It appears that prior spills have not chastened Massey, either. Brooke Jarvis at Yes! Magazine notes that the company stores 8.2 billion gallons of coal sludge in the same West Virginia county suffering from this week’s explosion, and that two months ago, “West Virginia’s Department of Environmental Protection issued a notice of violation because the dam failed to meet safety requirements.”

Don Blankenship, denier!

Massey’s owner, Don Blankenship, has as dark a record as his company on environmental issues. Blankenship believes in the “survival of the most productive,” Mike Lillis writes at The Washington Independent, which means that safety and environmental concerns come second. He “loves to slam ‘greeniacs’ for believing in things like climate change,” says Nick Baumann at Mother Jones. The Colorado Independent’s David O. Williams calls Blankenship “a notorious right-wing climate change denier and outspoken critic of the policies of ‘Obama bin Laden,’” and notes that Blankenship is on the board of the U.S. Chamber of Commerce, which has tried its hardest to squelch any climate legislation eking through Congress.

Methane and mountaintop removal

Although Massey and Blankenship stand out for their scorn of the environment, all coal production extracts a cost. Accidents and violations like Massey’s can devastate forests and streams, but coal’s biggest environmental impact comes when it is burned and pours tons of carbon dioxide into the atmosphere. As Yes! Magazine’s Jarvis puts it, “Coal may be cheap now, but that’s simply because we’re not counting—and don’t even know how to count—the long-term costs.”

The Obama administration has taken some steps towards limiting coal production. Last week the EPA announced restrictions that would limit mountaintop removal mining. But those regulations won’t ban the practice altogether. The Senate could, in theory, take up that task: Sen. Ben Cardin (D-MD) and Sen. Lamar Alexander (R-TN) introduced a bill a year ago that would make mountaintop removal mining so expensive it would be economically infeasible, effectively banning the practice, Mike Lillis reports for The Washington Independent. Although the bill accrued a few more sponsors during 2009, mostly liberal Democrats like Sen. Dianne Feinstein (D-CA) and Sen. Frank Lautenberg (D-NJ), it hasn’t attracted much attention and is still sitting in the Environment and Public Works Committee.

In the Mountain West, the Bureau of Land Management is opening up federal lands for coal mining and claiming it can’t require companies to flare off or capture methane, a greenhouse gas 20 times more potent than carbon dioxide, David O. Williams reports for The Colorado Independent. Without methane capture, the new mines would pour carbon pollution into the atmosphere. This BLM stance, Williams writes, has green advocates in Colorado “longingly reminiscing about the bygone days of the Bush administration,” which said it would require companies to manage methane.

Weekly Mulch: New bills and old money

Climate legislation is returning to the Senate’s docket, and leaders on Capitol Hill are hoping that this version, a compromise bill spearheaded by Sens. John Kerry (D-MA), Lindsey Graham (R-SC) and Joe Lieberman (I-CT), can pass without getting caught in the morass of money and politics that has delayed action so far.

A long, long time ago…

Remember, there was a time when Congress was going to pass climate legislation before the international climate change negotiations in Copenhagen. President Barack Obama was going to show up with a bill in hand and lead the world towards a better climate future. After the House passed its climate bill in June 2009, the Senate began discussing climate change, and a first stab by Sen. Kerry and Sen. Barbara Boxer (D-CA) went nowhere. Now, Kerry has turned to less liberal colleagues to draft an alternative that would appeal to moderates and even Republicans.

Now the Massachusetts senator is promising that climate change isn’t dead. A new bill is coming—more information may be in the offing as early as today, as Kate Sheppard reports at Mother Jones.

Third time’s the charm

Sen. Kerry is trying a new tactic to pass climate legislation. He’s waiting to release his plan until he knows the bill has the 60 supporters it needs to circumvent a filibuster. The details have not been hammered out yet, and even the Senators who’ve been in talks with Kerry, Graham, and Lieberman don’t seem to have a clear sense of what will be in the version that will emerge.

In the House, Rep. Henry Waxman (D-CA), chair of the Energy and Commerce Committee, released an ambitious draft of the legislation, let lobbyists and members of Congress fight over it, and passed a much-changed edition months later. Sen. Kerry tried a similar plan on his side of Capitol Hill (that was the Kerry-Boxer bill), but it did not work.

With this piece of legislature, Sens. Kerry, Graham, and Lieberman are working out the compromises before they release the legislation. Both reporting and speculation about their bill say that it will abandon the cap-and-trade system passed in the House. Cap-and-trade restricts carbon emissions across the economy; a variation on that policy that the Kerry-Graham-Lieberman bill may favor will limit the system to a few sectors.

Will it work?

Kerry’s expected bill may be a much weaker plan than any proposed so far, yet it is still not certain that the Senate will support it. The lead authors of the bill have been meeting with conservative Democrats and moderate Republicans, as Sheppard reports, but those targets have not promised support yet. Coming out of a meeting, Sen. George Voinovich (R-OH) told reporters: "There were some interesting things that were discussed in there and like everything else in the United States Senate, the devil is in the details."

From a distance, banner-day climate legislation still seems possible. Environmental groups like the Sierra Club, the National Wildlife Foundation, and the National Resources Defense Council believe that they will see a bill this year that caps carbon. These green groups would be able to live with the incentives handed to industry groups so far, according to Campus Progress’ Tristan Fowler.

“There are compromises [that can go] too far. Fortunately, I don’t think we’re getting near that territory at the moment,” Josh Dorner, a spokesman for the Sierra Club, told Fowler.

Sickly green

Before getting too excited about stamping a green seal of approval on Congress’ legislation, consider Johann Hari’s testimony in The Nation about the relationships between environmental groups and the industries that they oppose.

Hari has reported on climate change issues for years, and at first, he “imagined that American green groups were on these people’s side in the corridors of Capitol Hill, trying to stop the Weather of Mass Destruction. But it is now clear that many were on a different path—one that began in the 1980s, with a financial donation.”

Hari argues that as environmental groups began to reach out to polluters, handing them awards for green behavior and accepting support from their deep pockets, they learned to compromise too readily and accept political excuses for delaying action on climate change. While in other realms these compromises might fly, when the stakes are as high as they are on environmental issues, that behavior turns the stomach.

“You can’t stand at the edge of a rising sea and say, ‘Sorry, the swing states don’t want you to happen today. Come back in fifty years,’” Hari writes.

The green future

When Kerry, Lieberman and Graham do release the compromised bill, watch for a tsunami of money and influence that could pack the bill with prizes for specific industries—or derail it altogether. Just this week, the natural gas industry’s lobbyists told The Hill, a D.C.-based newspaper, that they were ready to fight with the coal industry over incentives in the Senate bill. At AlterNet, Harvey Wasserman writes that the nuclear industry spent $645 million in the past decade to get back into the energy game, according to a new report from American University’s Investigative Reporting Workshop. (Hint: that $645 million is working in their favor.)

In the Senate, the influence of oil companies will play an important role, according to David Roberts at Grist.

“While coal has a lot of power in the House, oil has enormous power in the Senate, particularly over the conservadems and Republicans needed to put the bill over the top,” Roberts explains.

No matter what legislation passes and what incentives it contains, environmentalists need to continue putting pressure on their representatives in Congress and on national environmental groups to push back against polluting industries and work to fix the world’s climate.

Weekly Mulch: Murkowski Vs. the EPA

On Thursday afternoon, Sen. Lisa Murkowski (R-AK) pulled out a rarely-used Congressional tool in an attempt to keep the Environmental Protection Agency (EPA) from regulating carbon and other greenhouse gasses. Sen. Murkowski offered a “resolution of disapproval” of the EPA’s impending action, which would limit companies’ carbon emissions.

The resolution would overturn the EPA’s finding that carbon dioxide is harmful to the public health. Three Democrats—Sen. Ben Nelson (D-NE), Sen. Blanche Lincoln (D-AR), and Sen. Mary Landrieu (D-LA)—joined Sen. Murkowski and 35 Republicans in sponsoring the resolution.

"Ms. Murkowski’s Mischief‘"

“This command and control approach is our worst option for reducing the gasses associated with climate change,” said Sen. Murkowski on the floor of the Senate yesterday. She called the EPA’s actions “backdoor climate regulations with no input from Congress” and said they would damage the country’s flailing economy.

The EPA first announced in April 2009 that carbon dioxide and other greenhouse gasses posed a threat to the public health. The agency formalized that finding last month, giving itself the power to regulate emissions of greenhouse gasses under the Clean Air Act. In March 2010, for instance, the agency is expected to announce carbon emissions rules for the auto industry that would match California’s higher standards. Sen. Murkowski’s resolution would derail that process.

Sen. Murkowski argued that she wants to give Congress room to come up with a legislative solution to climate change, but her critics see a more dangerous tilt to her resolution. "It’s a radical attempt by the legislative branch to interfere with executive branch scientists," writes David Roberts at Grist.

Responding to “Ms. Murskowski’s mischief” on the Senate floor yesterday, Sen. Barbara Boxer (D-CA) called the resolution an “unprecedented effort to overturn scientific decision” and “a direct assault on the health of the American people.”

Resolution of disapproval

What is a “resolution of disapproval?” Grist’s Roberts called it “the nuclear option.”

“It would rescind the EPA’s endangerment finding entirely and thereby eliminate its authority over both mobile and stationary sources,” Roberts explains. “Furthermore, the administration would be prohibited from passing a regulation “substantially the same” as the one overruled, so the constraint on the EPA would effectively be permanent.”

This type of resolution was created by the Clinton-era Congressional Reform Act. The resolution has one big advantage: It cannot be filibustered. Passage requires only a majority in both houses of Congress. Members have tried using it in the past to delay the Dubai Ports World deal, derail FCC regulations on new media, and stop the flow of bailout funds.

Kate Sheppard at Mother Jones has been following Sen. Murkowski’s actions closely. She reports that “Senate supporters of climate action say Murkowski could obtain the votes of moderate Democrats from coal, oil, and manufacturing states. However, a resolution would still need to be approved by the House and signed by the president—both long shots, to put it mildly. ‘I think we’re a little worried about [Murkowski’s resolution] winning. I’m not sure we’re worried about it becoming law,’ a Senate Democratic staffer says.”

But Grist’s Roberts argues that passage in the Senate alone would be a problem. “Even if blocked by the House or vetoed by the president, such a public, bipartisan slap at the administration would be highly embarrassing and demoralizing,” Roberts writes. “It would mean at least ten conservative Democrats washing their hands of the administration’s initiative.”

Climate change and Congress

Sen. Murkowski insists that she’s still ready to work with her colleagues on climate change and that it’s better to approach the problem of climate change via legislation, not regulation.

But no one in Washington believes that climate change legislation is going to pass—even come to the Senate floor—any time soon. The issue was already in line behind health care, and the election of Republican candidate Scott Brown to Sen. Ted Kennedy’s Massachusetts seat this week means that none of the bills that the Senate is working on are likely to come to a vote this year.

“There was hope that the [climate] bill would come to the floor in the spring,” writes Steve Benen at Washington Monthly. “Regrettably, a narrow majority of Massachusetts voters have made it significantly more likely that Congress won’t address the problem at all. Proponents focused on solutions have vowed to "persist," but Massachusetts has made a difficult situation considerably worse.”

The role of special interests

Sen. Murkowski has come under criticism for allowing Bush-era EPA administrators, now lobbyists representing clients on climate change issues, to help her craft an earlier amendment cracking down on the EPA. Yesterday, she said that those criticisms are “categorically false.”

But as JP Leous reports at Care2, Sen. Murkowski does receive substantial backing from energy industries that oppose climate change legislation and regulation.

“According to OpenSecrets.org Sen. Murkowski has received hundreds of thousands of dollars from polluting companies, and some of her biggest campaign contributors in recent years include firms with fossil-fueled motives like Exxon Mobil Corp,” Leous writes “Add those dots into the mix and a different picture emerges — and it starts to look like a person who is poised to introduce legislation next week attacking the Clean Air Act.”

On the Senate floor yesterday, Sen. Boxer charged, “Why would the Senate get in the business of repealing science? Because that’s what the special interests want to have happen now. Because they’re desperate.”

The Democratic Senators who co-sponsored the resolution also come from energy producing states where companies object to the new EPA regulations.

If at first you don’t succeed…

If Sen. Murkowski’s resolution does pass the Senate, there’s little chance it will pass the House as well. But this isn’t the only option that regulation opponents are looking at to fight the EPA. The Chamber of Commerce and other groups are planning to challenge the regulatory action in court, as Mother Jones’ Sheppard reports.

Last week, these opponents met to discuss their strategy. What’s interesting, Sheppard says, is that “the group was apparently divided on the best course of action. The Hill observes that "two camps have emerged." One wants to challenge whatever rules the EPA issues, while another wants to question the science of global warming itself.”

We’re back to that old saw? With legislation off the table, the fight over climate change, for now, is in the regulatory arena.
